MINUTES
November 7, 2023,
The regular meeting of the Stanley County Commission was called to order at 5:02 P.M. (CT) by Chairman Dana Iversen with Commissioners Mike Kenzy, Craig Heller, Sonny Harrowa and Gary Grittner. Also present was Treasurer Bill Konst, Register of Deeds Patti Duffy, Highway Superintendent Lee Smith, Capital Journal Iain Woessner and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.
Commissioner Craig Heller requested to amend the Agenda by adding Auto Gates.

Auditor Report: Auditor Philena Burtch presented the Commissioners with the September 2023 Budget Expenditure Report showing each department’s expenses as of September 30, 2023, Fiscal Revenue Report as of September 30, 2023, and Outstanding Disbursements as of November 6, 2023.
SALARIES BY OFFICE: Commissioners - $3,759.88; Auditor - $5,493.45; Treasurer - $5,585.39; States Attorney - $10,963.76; Custodial - $2,592.34; Director of Equalization - $7,135.41; Register of Deeds - $3,444.71; Coroner - $57.07; Road & Bridge - $26,487.86; Weed & Pest - $463.75; Fairgrounds - $9,116.84; Extension - $1,341.29; Employee Health Insurance - $18,186.63; SD Retirement System, withheld and match - $11,488.50; Electronic Transfer; FICA, Medicare and Withholding Tax - $23,198.80.

Treasurer Report: Bill Konst presented the Commissioners with Delinquent Property Tax report as of October 31, 2023. Bill’s goal was to have the delinquent property tax due for taxes due prior to 2023 total below $50,000.00 by October 31, 2023, it is less than $23,000.00. Bill explained that calling people to remind them, and send reminder letters has really helped with this. The Treasurers office will be calling and sending reminder letters for delinquent property taxes still owed for 2023, interest accrues the first of every month.
Courthouse Elevator: The courthouse elevator has been out of order since the end of July. Until the unpaid debt is paid, the elevator company will not fix or service our elevator. State’s Attorney Tom P Maher and Auditor Burtch spoke with the contractor regarding the unpaid debt. The amount due is a penalty for late delivery of the elevator, plus local and state taxes. This information was forwarded to the elevator company, to date, we have not received a response.
The Commissioners agreed to turn all this information over to Consumer Protection.
Fairgrounds - Tractor Rental: Motion by Gary Grittner, second by Craig Heller, to approve tractor rental agreement with Grossenburg Implement, 100HP tractor at $25.00 per hour. All voted Aye. Motion Carried.
Grandstand Storage Rental – City of Fort Pierre: Motion by Sonny Harrowa, second by Gary Grittner, to approve Rental Agreement for City of Fort Pierre to rent under the Grandstand November 1, 2023 through April 20, 2024, at $1,500.00 per month. All voted Aye. Motion Carried.
SD Vacation Guide, Missouri River Guide & Adventure Map Advertising: Motion by Craig Heller, second by Gary Grittner, to deny this ad campaign. All voted Aye. Motion Carried.
Highway Department: Lee Smith presented the Commissioners a report of work performed by the Highway Department for the month of October 2023, which consists of hauling and laying gravel, blading, mowing, service and maintenance of equipment. Lee informed the Commissioners that he is sending a four of the highway crew to a SD Local Transportation Assistance Program meeting in Oacoma in December.
Auto Gates: Lee Smith informed the Commissioners that if the County chooses to remove the auto gates and replace them with fence, it will cost $10,000.00 for one mile of fence, with steel fence posts. One new auto gate cost $10,000.00 plus labor. The Commissioners would like to know how many auto gates and the location of each one on county roads, and how many miles of fence would be needed if the auto gates are removed.
Lee Smith informed the Commissioners that Morris, Inc. has requested an additional 20,000 ton of dirty gravel for the new Missouri River Bridge. Morris, Inc., and Stanley County will need to amend the original contract.
Chantier Creek Road Lakeside Use Area – SD GF&P Amendment to Agreement #2022-58-1: Motion by Mike Kenzy, second by Gary Grittner, to accept and approve Chairman Iversen to sign the SD GF&P Amendment to Agreement #2022-58-1. All voted Aye. Motion Carried.
SDDOT SD511 – Application for Permission to Enter Road Advisories and Closures into SD511: Motion by Sonny Harrowa, second by Craig Heller, to approve to apply for Permission to Enter Road Advisories and Closures into SD511. All voted Aye. Motion Carried.
Raise – Road & Bridge: Motion by Craig Heller, second by Sonny Harrowa, to approve 50¢ per hour, 6 months raise for Road & Bridge equipment operator Zachery Knowlton, effective November 15, 2023. All voted Aye. Motion Carried.
Automatic Budget Supplement from Rural Access Infrastructure Fund to Road & Bridge Salary: Motion by Sonny Harrowa, second by Mike Kenzy, to approve Automatic Budget Supplement from Rural Access Infrastructure Fund to Road & Bridge Salary in the amount of $25,305.50, as the Small Structure Project has been completed for 2023 by Road & Bridge. All voted Aye. Motion Carried.
National Center for Public Land Counties: Motion by Sonny Harrowa, second by Craig Heller, to deny support for the National Center for Public Land Counties. All voted Aye. Motion Carried.

Supporting Operation Green Light for Veterans
WHEREAS, the residents of Stanley County have great respect, admiration, and the utmost gratitude for all the men and women who have selflessly served our country and this community in the Armed Forces; and
WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in maintaining the freedoms and way of life enjoyed by our citizens; and
WHEREAS, Stanley County seeks to honor individuals who have made countless sacrifices for freedom by placing themselves in harm’s way for the good of all; and
WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars, religious groups, civil service, and by functioning as County Veterans Service Officers in 29 states to help fellow former service members access more than $52 billion in federal health, disability and compensation benefits each year; and
WHEREAS, Approximately 200,000 service members transition to civilian communities annually; and
WHEREAS, an estimated 20 percent increase of service members will transition to civilian life in the near future; and
WHEREAS, studies indicate that 44-72 percent of service members experience high levels of stress during transition from military to civilian life; and
WHEREAS, active military service members transitioning from military service are at a high risk for suicide during their first year after military service; and
WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize Operation Green Light for Veterans; and
WHEREAS, the Stanley County appreciates the sacrifices of our United States military personnel and believes specific recognition should be granted; therefore be it
RESOLVED, with designation as a Green Light for Veterans County, Stanley County hereby declares from November 1st 2023, through Veterans Day, November 11th 2023 a time to salute and honor the service and sacrifices of our men and women in uniform transitioning from active service; therefore, be it further
RESOLVED, that in observance of Operation Green Light, Stanley County encourages its citizens in patriotic tradition to recognize the importance of honoring all those who made immeasurable sacrifices to preserve freedom by displaying green lights in a window of their place of business or residence from November 6th through the 12th, 2023.

CONTINGENCY TRANSFER
WHEREAS, insufficient appropriation was made in the 2023 adopted budget for the Elections and Coroner departments to discharge just obligations of said appropriations: and
WHEREAS SDCL 7-21-32.2 provides that transfers be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;
THEREFORE, BE IT RESOLVED that the appropriation be transferred from the contingency budget to the Elections department budget 101-112-429.00 (Commissioners Contingency) $673.00 – Expenditure budget 101-120-434.30 (Election Equipment) in the sum of $673.00; Coroner department budget 101-112-429.00 (Commissioners Contingency) $6,500.00 – Expenditure budget 101-213-422.10 (Coroner Professional Fee) in the sum of $6,500.00.

Discussion: Commissioner Gary Grittner discussed concerns regarding the Western Dakota Regional Water System. This project will take Missouri River water to western South Dakota. Gary questioned the route of the pipeline and if the County has any say. This project is in the very early stages of planning.
The Hughes/Stanley County Emergency Manager has moved on. Stanley County has discussed in the past about having our own Emergency Manager. The State Office of Emergency Management has stated that they will assist, information way, if Stanley County chooses to create the new position. The Commissioners requested information as to how this position functions in other small counties.
Thanksgiving Holiday Closing: Stanley County offices will be closed Thursday and Friday, November 23 and 24, 2023, in observance of the Thanksgiving Holiday.
