November 10, 2022
The regular meeting of the Stanley County Commission was called to order at 5:14 P.M.(CT) by Vice Chairman Sonny Harrowa with Commissioners Dennis Booth, Mike Kenzy and Craig Heller. Commissioner Dana Iversen was absent. Also present was State’s Attorney Tom P. Maher, Director of Equalization Tracy Schmitt, Highway Superintendent Lee Smith, Fairgrounds Manager Scott Deal, Treasurer Bill Konst, Gary Grittner, Harley Moser, Capital Journal Gwen Albers and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Auditor Report: Auditor Philena Burtch presented the Commissioners with the September 2022 Budget Expenditure Report showing each department’s expenses as of September 30, 2022 and Outstanding Disbursements by Account & Budget Remaining as of November 10, 2022.
SALARIES BY OFFICE: Commissioners - $3,747.55; Auditor - $3,701.20; Treasurer - $5,511.98; States Attorney - $7,791.13; Custodial - $2,331.12; Director of Equalization - $4,611.48; Register of Deeds - $3,210.66; Road & Bridge - $23,339.32; Weed & Pest - $450.97; Fairgrounds - $5,782.60; Extension - $1,165.36; Employee Health Insurance - $18,043.31; SD Retirement System, withheld and match - $8,153.96; Electronic Transfer; FICA, Medicare and Withholding Tax - $18,179.60.

Harley Moser – Property Taxes: Harley Moser purchased land. Harley came in to pay the property taxes and was informed that the property taxes had already been paid by the former property owner, and was told to pay the former property owner instead of the county. Harley talked with a couple other offices and it was discovered that Harley only purchased a small section of land and a new parcel number should have been created. Harley would like the county’s help to get the money back that he paid to the former property owner. Since this situation should have been handled differently, the county will assist Harley.
Bruce Wisley – Bridge Inspection Report: Due to the weather, Bruce will present the bridge inspection report during the December 6th Commission meeting.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of October, 2022, which consists of blading, hauling gravel, mowing, replace culverts on Richard Doud Road, service and maintenance of equipment. Lee informed the Commission that the State is starting to move on the Bad River Road bridge replacement project.
2017 John Deere Motor Grader Extended Lease: Motion by Craig Heller, second by Dennis Booth, to approve to extend the lease on the 2017 John Deere Motor Grader for three months at $ 3,270.67 per month. All voted Aye. Motion Carried.
2006 Water Tanker: Motion by Craig Heller, second by Mike Kenzy, to approve the purchase of the 2006 Stephens Water Tanker in the amount of $19,500.00. All voted Aye. Motion Carried.
Hayes Shop Lighting Project: Motion by Mike Kenzy, second by Dennis Booth, to accept Will Clark Electric Proposal for the Hayes Shop Lighting Project in the amount of $7,950.00. All voted Aye. Motion Carried.
Fairgrounds -Tractor: Motion by Dennis Booth, second by Craig Heller, to approve the lease of the John Deere 75HP tractor in the amount of $25.00 per hour. All voted Aye. Motion Carried.
Cottonwood Tree: Scott Deal informed the Commission about a large cottonwood tree located at the northside of the arena that is dead and needs to be removed.
Security Camera System: Scott Deal would like security camera system for the fairgrounds. The Commission suggested to get bids for a security camera system for the fairgrounds and the county highway shop.
State 4-H Finals Contract: Scott Deal would like to write up a three-year contract for State 4-H Finals Rodeo and include the number of stalls that will be available.
National Little Britches: Scott Deal informed the Commission that the National Little Britches is selling used stall fronts and gates. They have a total of 548 panels for sale, Scott would like to put a bid in of $10 per panel. Motion by Craig Heller, second by Dennis Booth, to place a bid on 548 panels to the National Little Britches, not to exceed $5,500.00. All voted Aye. Motion Carried.
Grandstand – City of Fort Pierre – Storage: Scott Deal informed the Commission that the City of Fort Pierre is looking for new space to store city shop equipment. The Grandstand was suggested. It is not heated, however the city crews will be able to plug the equipment in and the city crews will be out of the elements to work on equipment.
Canvass of General Election: Upon review of the Canvass, Motion by Dennis Booth, second by Craig Heller, to approve the Canvass for the General Election of November 8, 2022. All voted Aye. Motion Carried.
Add Treasurer to Bank Accounts: Motion by Craig Heller, second by Mike Kenzy, to add Treasurer Bill Konst to all Stanley County Bank accounts, ACH, Execubank. All voted Aye. Motion Carried.
Hughes County 2023 Jail Contract: Motion by Mike Kenzy, second by Craig Heller, to accept and approve Vice Chairman Harrowa to sign the Hughes County 2023 Jail Contract, daily rate is unchanged at $95.00 per day. All voted Aye. Motion Carried.
Hughes County 2023 Juvenile (JSC) Contract: Motion by Dennis Booth, second by Craig Heller, to accept and approve Vice Chairman Harrowa to sign the Hughes County 2023 JSC Contract, daily rate is unchanged at $295.00 per day. All voted Aye. Motion Carried.
Generator Project 2022 – Resolution 2022-22: The Stanley County Courthouse is considered a storm shelter. Motion by Craig Heller, second by Dennis Booth, to authorize the Stanley County Auditor or Stanley County Commission Chairman or Vice Chairman to sign and submit this resolution and application to the South Dakota Office of Emergency Management for the Hazard Mitigation Grant Program funding BRIC22 for a 100,000-watt generator for the Stanley County Courthouse. All voted Aye. Motion Carried.
RESOLUTION 2022-22
TO SUBMIT APPLICATION FOR FUNDING REQUEST FOR THE STANLEY COUNTY GENERATOR PROJECT 2022
WHEREAS, Stanley County has identified the need to purchase and install a 100,000-watt generator at their Stanley County Courthouse located at 08 East 2nd Avenue, Fort Pierre, in order to provide emergency backup power to operate the emergency operations center in the event of a power outage as a result of an ice storm, tornado or other disaster event causing loss of power; and
WHEREAS, Stanley County anticipated purchasing and installing a 100,000-watt generator for the Stanley County Courthouse;
WHEREAS, The County purposes to apply to the South Dakota office of Emergency Management of the Hazard Mitigation Grant Program BRIC22 funding to assist with the cost of purchasing and installing the generator; and
WHEREAS, the citizens of Stanley County have been afforded the opportunity to participate, comment, and provide input in the plan content and mitigation strategies;
NOW THEREFORE BE IT RESOLVED by the County Commission Board of Stanley County that: The commissioners authorize the Stanley County Auditor or the Board Chairman or Vice Chairman to sign and submit this resolution and application to the SD Office of Emergency Management for the Hazard Mitigation Grant Program funding BRIC22 for a 100,000-watt generator. Adopted by the Stanley County Board of Commissioners this 10th day of November, 2022. This resolution is effective immediately upon passage.

Project Boundary Fence – Cyber Security: Project Boundary Fence is a partnership between Dakota State University and the South Dakota Attorney General’s office to help secure South Dakota city and county networks from cyber-attacks. This service is funded by South Dakota Consumer Protection, therefore no cost to Stanley County taxpayers.
Motion by Craig Heller, second by Dennis Booth, to schedule an assessment with Dakota State University Project Boundary Fence. All voted Aye. Motion Carried.
Local Assistance & Tribal Consistency Fund (LATCF): The U.S. Department of the Treasury announced the release of Local Assistance and Tribal Consistency Fund (LATCF) payments to counties. The LATCF provides two equal payments to “eligible revenue sharing counties” under the American Rescue Plan Act (ARPA). The purpose of LATCF is to serve as a general revenue enhancement program.
Motion by Dennis Booth, second by Craig Heller, to authorize Stanley County Auditor to sign and submit Application for Local Assistance & Tribal Consistency Fund. All voted Aye. Motion Carried.
Resignation – Director of Equalization Assistant: Motion by Craig Heller, second by Mike Kenzy, to accept Resignation of Director of Equalization Assistant Brandy Carroll, effective November 11, 2022. All voted Aye. Motion Carried.
Automatic Budget Supplement – Road & Bridge: Motion by Dennis Booth, second by Craig Heller, to approve Automatic Budget Supplement, in the amount of $501.86, for Road & Bridge Health Insurance, to reflect COBRA insurance payment. All voted Aye. Motion Carried.
Contingency Transfer – Resolution 2022-23: Motion by Craig Heller, second by Dennis Booth, to approve Resolution 2022-23 Contingency Transfer – Fairgrounds Equipment, in the amount of $35,000.00. All voted Aye. Motion Carried.
RESOLUTION 2022–23
CONTINGENCY TRANSFER
WHEREAS, insufficient appropriation was made in the 2022 adopted budget for the Fairgrounds department to discharge just obligations of said appropriations: and
WHEREAS SDCL 7-21-32.2 provides that transfers be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;
THEREFORE, BE IT RESOLVED that the appropriation be transferred from the contingency budget to the Fairgrounds department budget 101-112-429.00 (Commissioners) $35,000.00 – Expenditure budget 101-524-434.30 (Equipment) in the sum of $35,000.00.
Motion by Craig Heller, second by Dennis Booth, to approve Contingency Transfer in the amount of $35,000.00 to Fairgrounds Department - Equipment. All voted Aye. Motion Carried.

Discussion: Treasurer Bill Konst would like to check into allowing taxpayers to make payments over the phone. Bill feels it would be more convenient for Stanley County property owners.
