May 6, 2025
The regular meeting of the Stanley County Commission was called to order at 5:00 P.M. (CT) by Chairman Craig Heller with Commissioners Mike Kenzy, Dana Iversen, Sonny Harrowa and Gary Grittner. Also present was State’s Attorney Tom P. Maher, Treasurer Bill Konst, Government Building Manager Rick Striker, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, Hughes/Stanley County Emergency Management Deputy Nick Dooley, Lori Jacobson, GrowSD Jared Groos, Central South Dakota Enhancement District David Reiss, Lura Kirkpatrick, Mindy Kirkpatrick, RWE Sue Hansen and John Douglas, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.
Commissioner Iversen requested to amend the Agenda by adding Haul Road Agreement and County Access Trail to the discussion.

Auditor Report: Auditor Philena Burtch presented the Commissioners with the Budget Expenditure Report showing each department’s expenses as of March 31, 2025, Fiscal Revenue Report as of March 31, 2025, and Outstanding Disbursements as of May 5, 2025.

Government Building: Ground Water Monitoring Wells: Rick Striker presented the Commission with two proposals for ground water monitoring wells. After some discussion, the Commission agreed to wait until after the second laser survey is completed to see how much the courthouse moves.
GrowSD: Jared Groos explained Grow South Dakota programs are sustainable to communities through housing, community, and economic development. Jared emphasized that the funds from Stanley County, assists Stanley County residents and businesses. GrowSD strengthens homes by completing major and minor home repairs, furnace repairs and replacements and weatherization services. Empowers people through housing loans by making their dream of homeownership come true with the financing of a home. Investing in businesses by supporting entrepreneurs through loans and technical assistance.
Treasurer Report: Treasurer Bill Konst informed the Commission of interest earned for April 2025 is $14,548.52, Wheel Tax collection is $5,889.47, and delinquent taxes to collect is $37,457.05.
Fairgrounds - Barn A: Motion by Sonny Harrowa, second by Dana Iversen, to approve to remove/tear down Barn A, as damages exceed the cost to repair. All voted Aye. Motion Carried.
Industrial Ceiling Fans in Grandstand: Scott Deal informed the Commission that installing large industrial ceiling fans in the Grandstand would improve the air flow. The Commission requested Scott to get quotes.
Toolcat: Scott Deal informed the Commission that the fairgrounds Toolcat has been used a lot and he would like to replace it while it still has value. A new Toolcat, with government discounts is $64,000.00, and the dealer will give $19,000.00 trade-in value. The Commission requested Scott to look around at other dealers and options.
Highway Department – Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of April 2025, which consists of sign maintenance, pulling shoulders, hauling gravel, blading, service and maintain equipment.
Central South Dakota Enhancement District: David Reiss informed the Commission that the Hughes/Stanley County Pre-mitigation Disaster application has been submitted. The State of South Dakota has funds for the pre-mitigation plans. David has been participating in the Stanley County work group regarding the zoning ordinance for wind energy facilities. CSDED has been assisting with the application process for the geological survey for the area north on South Dakota Highway 1806 and everything will be ready to submit before the end of May. CSDED is also assisting with the 1st stage West River/Lyman Jones water project south out of Stanley County.
Malt Beverage License Renewal – Brandy Lodge LLC: Motion by Dana Iversen, second by Sonny Harrowa, to approve the 2026 Retail (on-off sale) Malt Beverage & SD Farm Wine License Renewal for Brandy Lodge LLC, July 1, 2025, through June 30, 2026. All voted Aye. Motion Carried.
Raise – State’s Attorney Legal Assistant Harlie Petrak 50¢ 1 Year: Motion by Gary Grittner, second by Dana Iversen, to approve State’s Attorney Legal Assistant Harlie Petrak 50¢ per hour 1 year raise, effective May 20, 2025. All voted Aye. Motion Carried.
Abatements: Record #8382 – Motion by Sonny Harrowa, second by Mike Kenzy, to approve Abatement and refund request for Record #8382 in the amount of $283.99, refund total $81.14, 2024 Taxes Due and Payable 2025, as mobile home was sold in April 2024, and the new owners moved the mobile home from Stanley County in May 2024. All voted Aye. Motion Carried.
Record #300136 – Motion by Sonny Harrowa, second by Mike Kenzy, to approve Abatement for Record #300136 in the amount of $188.35, 2012 Taxes Due and Payable 2013, $62.10, 2013 Taxes Due and Payable 2014 $29.47, 2014 Taxes Due and Payable 2015 $96.78, plus interest, as mobile home was moved from Stanley County. All voted Aye. Motion Carried.
Record #3247 – Motion by Gary Grittner, second by Sonny Harrowa, to approve Abatement and refund request for Record #3247 in the amount of $10,254.88, refund total $9,081.77, 2021 Taxes Due and Payable 2022 $2,655.07, 2022 Taxes Due and Payable 2023 $2,692.77, 2023 Taxes Due and Payable 2024 $2,560.74, 2024 Taxes Due and Payable 2025 $2,346.30, as a clerical error occurred, structure valued on this property was destroyed by fire prior to new owner purchase, however, the value of the structure was not removed from the parcel. All voted Aye. Motion Carried.
Stanley County EM Laptop and Radio: EM Laptop – Motion by Gary Grittner, second by Sonny Harrowa, to approve the purchase of an Intel Core i7 laptop from Brite, in the amount of $2,981.00, for use by a designated Stanley County employee during emergency situations, disasters, or events in Stanley County. All voted Aye. Motion Carried.
EM Radio – Motion by Gary Grittner, second by Sonny Harrowa, to approve the purchase of a Motorola APX6000 Portable radio from Motorola Solutions, in the amount of $4,768.37, for use by a designated Stanley County employee, during emergency situations, disasters, or events in Stanley County. All voted Aye. Motion Carried.
Automatic Budget Supplement – Fairgrounds: Motion by Sonny Harrowa, second by Dana Iversen, to approve Automatic Budget Supplement in the amount of $10,000.00 to Fairgrounds Maintenance (101-524-425), to reflect payment from City of Fort Pierre for 2nd Quarter 2025 Fairgrounds Subsidy. All voted Aye. Motion Carried.
Upcoming Workshops – SDACO Officials Spring Workshop
Discussion: RWE Clean Energy Sue Hansen has taken over as wind energy project manager in our region. Sue offered her help with the county ordinances and any questions regarding the project. John Douglas is the operation and maintenance for the wind turbine.
Commissioner Grittner requested that some collection agencies come to a meeting to discuss collecting on court appointed attorney fees. Auditor Burtch stated that the County has been using the same local collection agency for years and would rather not change. The County also has a repayment plan in place for court appointed attorney fees, confinement fees and welfare assistance.
Commissioner Iversen questioned preparing a haul road agreement along an established access trail into Jones County to haul out of the Iversen gravel pit. There was an agreement with the previous owner, however, the new owners are not allowing Jones County access of the trail to the gravel pit. Established trails cannot be blocked. If a haul road agreement cannot be established, the possibility of the County claim right-of-way, declare emanate domain and take the trail off the tax roll and the County claim it as a low maintenance trail was discussed.
