The regular meeting of the Stanley County Commission was called to order at 5:04 P.M.(CT) by Chairman Dana Iversen with Commissioners Dennis Booth, Mike Kenzy, Craig Heller and Sonny Harrowa. Also present were State’s Attorney Tom P. Maher, Treasurer Peggy Dougherty, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, Director of Equalization Tracy Schmitt, Grow South Dakota Jarad Groos, Clark Insurance Zach Clark, Emergency Manager Rob Fines, Colby Jensen, CSDED David Reiss, Jim Ross, Gerrick McComsey, Bob Bak Construction Henry Bak, Tanya Kayser, Gary Grittner and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Treasurer Peggy Dougherty presented the Commissioners with the Treasurer Report, April 2022 bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the April 2022 Budget Expenditure Report showing each department’s expenses as of April 30, 2022, Fiscal Revenue Totals Report as of April 30, 2022 and Outstanding Disbursements as of June 9, 2022, showing budget remaining for each department.

Canvass of June 7, 2022, Primary Election: Upon review of the Canvass, Motion by Dennis Booth, second by Sonny Harrowa, to approve the Canvass of the Primary Election of June 7, 2022. All voted Aye. Motion Carried.
Grow South Dakota: Jared Groos thanked the Commissioners for their time and continued support of the Grow South Dakota programs. Jared explained Grow South Dakota programs are sustainable to communities through housing, community and economic development. Jared emphasized that the funds from Stanley County, assists Stanley County residents and businesses. Grow South Dakota strengthens homes by completing major and minor home repairs, furnace repairs and replacements and weatherization services. Empowers people through housing loans by making their dream of homeownership come true with the financing of a home. Investing in businesses by supporting entrepreneurs through loans and technical assistance. Supporting business borrowers by offering no cost confidential business management consulting services to support potential and existing businesses in South Dakota. Reinforcing communities by providing temporary emergency assistance to help individuals and families stabilize their homes with rental assistance, utility assistance, mortgage assistance and other emergency assistance.
Director of Equalization: Tracy Schmitt explained to the Commission that the Stanley County Planning & Zoning Board approved Plat of Lots 3R and 4R and 5R Look Out Ridge Estates, Plat of Lots 6R and 7R and 8R Look Out Ridge Estates, and Plat of Lot 9R Look Out Ridge Estates in 2020.

Temporary Data Entry Hire: Motion by Dennis Booth, second by Mike Kenzy, to approve the temporary hire of Talia Schmitt, in the Director of Equalization office, for data entry at $15.00 per hour, not to exceed 27 hours per week, no benefits. All voted Aye. Motion Carried.
Clark Insurance – County Employee Health Insurance: Zach Clark presented two similar plans for the county employee health insurance. Zach explained that Stanley County has options, keep the current plans and receive a 7.32% increase. Look at other options with Wellmark. Look at other carriers such as Avera, Sanford, Health Partners or UnitedHealthCare. The County’s employee health insurance is due for renewal on August 1, 2022.
James Ross – Land Slide: Jim Ross owns property north on SD Highway 1806. The land has been sliding. CSDED David Reiss explained that FEMA assistance has two programs, either demo the structures or relocate. A land slide is considered a disaster risk, therefore, the land has to be open space. Jim Ross explained to the Commission his plan to save the house, he does not plan to move it or demo it. The Commission stated that the County is not going to make them demo or relocate, it is Jim’s decision.
Emergency Management: Rob Fines is retiring as Hughes/Stanley Emergency Management & Disaster manager as of June 30, 2022. Rob reintroduced Colby Jensen. Colby has been working with Rob for two and a half years.
Executive Session – Personnel – SDCL 1-25-2(1): Motion by Sonny Harrowa, second by Craig Heller, to go into Executive Session-Personnel-SDCL 1-25-2(1) at 5:57 P.M. All voted Aye. Motion Carried.
Chairman Iversen declared to reconvene at 6:18 P.M.
After the Commission came out of executive session for personnel with Treasurer Peggy Dougherty, the commission, through Chairman Iversen, requested that Treasurer Dougherty resign or retire. Treasurer Dougherty said that she would need one week to decide on whether to resign or retire. The Commission indicated that would be acceptable.
Fairgrounds: Scott Deal informed the Commissioners that the Civic Center in Rapid City contacted Scott about their old bleacher seats. The seats will fit over the existing bleachers under the roof of the grandstands. The Civic Center explained that this process will happen later this year or early next year. The Civic Center did not have a price set yet, they wanted to offer the seats to the Stanley County Fairgrounds first.
Water Truck - Scott Deal explained that the fairgrounds is in need of a water truck. State surplus has a 1995 International water truck. For SD State High School Rodeo, Scott rented a water truck for $900.00 per week.
Motion by Craig Heller, second by Sonny Harrowa, to approve the purchase of a 1995 International water truck from State surplus, not to exceed $16,700.00. All voted Aye. Motion Carried.
Workers for 4th of July Rodeo – Scott Deal explained to the Commission that the fairgrounds will need to hire extra workers for the 4th of July Rodeo.
Dakota Heritage Donation – Play Set – Scott Deal explained to the Commission that Dakota Heritage has donated a play set to the fairgrounds. Scott is hoping to have the play set in place before 4-H Finals.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of May, 2022, which consists of blading, hauling gravel, service and maintenance of equipment.
Bak Gravel Pit: This subject has been tabled.
Seasonal Hire: Motion by Craig Heller, 2nd by Dennis Booth, to approve the seasonal hire of Van Johnson as equipment operator at $25.00 per hour, no benefits, effective May 23, 2022. All voted Aye. Motion Carried.

Drought Disaster Declaration
WHEREAS, Stanley County continues to suffer from a natural disaster in the form of severe agricultural drought conditions, including extremely inadequate winter snowfall, meager spring rains, desolating winds accompanied with high temperatures and late frosts which have severely impacted all drought conditions, the Board of County Commissioners resolve that said drought conditions constitute a natural disaster of such severity and magnitude that an effective response is beyond the capabilities of this County, or even the State of South Dakota, and that Federal assistance is necessary, and there is no emergency plan available to alleviate the damage and economic chaos resulting from these conditions; and
WHEREAS, Stanley County does not have the financial resources to respond to this disaster; and
WHEREAS, the Board of County Commissioners of Stanley County is aware sparse pastures and lack of forage crops for the feeding of livestock is necessitating the reduction/disposal of livestock herds; and
WHEREAS, the Board of County Commissioners of Stanley County is aware that fall and spring planted small grains are already stressed from lack of rain and yields will be impacted; and
WHEREAS, the Board of County Commissioners of Stanley County realizes that an emergency has resulted from a lack of water in the agriculture community and the quality of water in stock ponds due to extreme low runoff, which could result in a high selenium concentration and livestock mortality,
WHEREAS, the Board of County Commissioners of Stanley County is aware that in addition to these conditions, the continuing drought conditions introduce a new element of synergism compounding the magnitude of devastation to our agricultural infrastructure,
NOW THEREFORE BE IT RESOLVED, the Board of County Commissioners of Stanley County, South Dakota, declares a natural disaster drought emergency; and it is
FURTHER RESOLVED, we, the Board of Commissioners of Stanley County respectfully petition the Governor of the State of South Dakota and the President of the United States to provide with all dispatch and remedies any state and/or federal assistance available for this type of emergency.
Commissioner Harrowa moved to adopt said resolution and Commissioner Heller seconded the motion.

Juneteenth Holiday: Stanley County Offices will be closed on Monday June 20, 2022, in observation of Juneteenth Holiday.
