MINUTES
June 7, 2018
The regular meeting of the Stanley County Commission was called to order at 5:08 P.M.(CDT) by Chairman Dana Iversen with Commissioners Dennis Booth, Mike Kenzy, Craig Heller and Sonny Harrowa present. Also present were State’s Attorney Tom P. Maher, Treasurer Peggy Dougherty, Highway Superintendent Lee Smith, County Health Nurse Carmella Bourk, 4-H Volunteer Crystal Neuharth, Jonathan Neuharth, Extension/4-H Jackie Husted, Grow SD Mark Nelson, Bob Riter, Dave Askins, Capital Journal, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Treasurer Peggy Dougherty presented the Commissioners with Treasurers report, April and May bank statement and daily cash, delinquent real estate and mobile home taxes paid, tax trust, miscellaneous receipts, (Grants, Register of Deeds receipts, etc.), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the Budget Expenditure Report showing each department’s expenses as of April 30, 2018, and the Outstanding Disbursements by account & budget remaining as of May 31, 2018.
Canvass of Primary Election: Upon review of the Canvass, Motion by Sonny Harrowa, second by Dennis Booth, to approve the Canvass for the Primary Election of June 5, 2018. All voted Aye. Motion Carried.
Executive Session – Care of Poor – SDCL 28-13-1: Motion by Sonny Harrowa, second by Mike Kenzy, to go into Executive Session-Care of Poor-SDCL 12-13-1 at 5:20 P.M. All voted Aye. Motion Carried.
Chairman Iversen declared to reconvene at 5:22 P.M.
Motion by Mike Kenzy, second by Dennis Booth, to approve Care of Poor Case #4786 in the amount of $170.27. All voted Aye. Motion Carried.
County Health Nurse: Carmella Bourk presented the Commissioners with the Community Health Nursing Quarterly Statistics report for March, April and May 2018. WIC Caseload is stable. WIC is a program for low-income, nutritionally at risk pregnant women, infants and children up to 5 years of age. Some of the benefits are supplemental nutritious foods, nutrition education and counseling, screening and referrals to other health, welfare and social services.
Carmella is still traveling to Kadoka, Wanbelee and Fort Thompson. The County’s WIC secretary has been traveling with Carmella to Fort Thompson due to staff shortage. They will be in Fort Thompson June 7, 19, 21 and 26, 2018.
Grow South Dakota: Mark Nelson informed the Commissioners that Grow South Dakota, or NESCAP, invested $200,000.00 in 2017 for qualifying reciprocates of Stanley County. This includes five active business loans and heating and energy efficiency assistance for two households in Stanley County.
4-H: Crystal Neuharth introduced her son Jonathan Neuharth to the Commissioners. Jonathan is very involved and busy in 4-H with 11 chickens, 9 sheep, goats, taking and painting pictures. He has been practicing for the 4-H horse show, which is scheduled for June 18, 2018, at the Stanley County Fairgrounds. Jonathan is very excited for the horse show.
Crystal stated that 4-H has a lot of activities and responsibilities in the program. Some of the activities include livestock judging, horse show, special foods contest, dog show, public presentation, fashion revue workshop and contest and achievement days. Crystal thanked the Commissioners for their continued support with the program.
4-H/Extension Jackie Husted explained to the Commissioners that enrollment for Hughes/Stanley County, combined is at 219, at this time last year there were 223.
Executive Session – Legal – SDCL 1-25-2(3): Motion by Dennis Booth, second by Sonny Harrowa, to go into Executive Session-Legal-SDCL 1-25-2(3) at 5:38 P.M. All voted Aye. Motion Carried.
Chairman Iversen declared to reconvene at 5:57 P.M.
Bob Riter reported to the Commissioners that after several months of discussion with the State of South Dakota and FEMA, there is a settlement agreement. Bob asked the Commissioners to authorize him to sign the agreement, along with a stipulation to dismiss lawsuit.
Motion by Sonny Harrowa, second by Craig Heller, to accept settlement agreement and approve Attorney Robert Riter to sign the agreement and stipulation to dismiss lawsuit. All voted Aye. Motion Carried.
Highway Department: Lee Smith presented the Commissioners with a report of the work completed in the month of May.
New County Pickup – Motion by Craig Heller, second by Sonny Harrowa, to approve purchase of a new pickup for the highway department, not to exceed $33,000.00. All voted Aye. Motion Carried.
Trailer for Skid-steer – Motion by Craig Heller, second by Dennis Booth, to approve purchase of a new trailer for the Skid-steer, not to exceed $5,300.00. All voted Aye. Motion Carried.
SDDOT Signage & Delineation Project – SD DOT will purchase and install new road signs and delineators. Once they are installed, it is up to the County to maintain them.
Motion by Sonny Harrowa, second by Craig Heller, to accept and approve Chairman Iversen to sign SDDOT Signage & Delineation Project Agreement. All voted Aye. Motion Carried.
Different County Shop – The current county shop has black mold and it’s too small to do maintenance on most of the equipment, trucks and trailers. Chairman Iversen and Lee have been looking at, and are in negotiations for, an existing building located on Buffalo Road. It has 6 bays with plenty of space for equipment. The building sits on 2.77 acres of land, with an adjoining lot, it will be less than 5 acres, plenty of room for equipment, trucks, trailers and to stockpile materials as needed for certain projects.
Secondary Road & Main County Roads: Lee Smith would like to know who is responsible to clean out and maintain cattle guards. Commissioner Booth stated that there may be an Ordinance on the books. Auditor Burtch will research. Lee stated that there have been quite a few approaches developing off the county roads. There are State Laws regarding the specifics of new approaches and existing trails. Chairman Iversen would like to adopt these State Laws at a County Level. Lee would also like to adopt existing access trails into the County inventory and incorporate the approaches and existing access trails that connect to County roads into the Ordinance. He would like it to read that the Commission is informed, with plans before an approach is built, if not, a fine will be placed on the land owner. Once the Ordinance is approved, a publication will be made available to the public.
Fort Pierre Fire Department: New Fire Hall Land Agreement has been tabled until the regular July Commission meeting, as some wording needs to be changed.
Executive Session – Personnel – SDCL 1-25-2(1): Motion by Mike Kenzy, second by Dennis Booth, to go into Executive Session-Personnel-SDCL 1-25-2(1) at 6:40 P.M. All voted Aye. Motion Carried.
Chairman Iversen declared to reconvene at 6:47 P.M.
Discussion: Stanley County had a jury trial June 6-7, 2018. The Judge told Tom P. Maher that she was impressed by the 100% jury selection turnout, it shows that Stanley County residents take their civic duty serious.
Fairgrounds: Sponsorship for the 4th of July Rodeo is going well. Scott Deal plans to talk to businesses again next week. Commissioner Heller stated that the area around the track needs to be mowed.
Auto Supplement: Motion by Sonny Harrowa, second by Dennis Booth, to approve Automatic Supplement to the Fairgrounds Repairs and Maintenance in the sum of $2,500.00, to reflect post horse racing grounds clean-up funds. All voted Aye. Motion Carried.
WIC Contract: Motion by Craig Heller, second by Mike Kenzy, to accept and approve Chairman Iversen to sign FY19 WIC Contract. All voted Aye. Motion Carried.
Register of Deeds – Plat Cabinet: Motion by Dennis Booth, second by Sonny Harrowa, to approve purchase of Plat Cabinet to be purchased with ROD M/P Fund, not to exceed $3,400.00. All voted Aye. Motion Carried.
Malt Beverage Liquor License Renewal: Motion by Craig Heller, second by Mike Kenzy, to approve liquor license renewal for Chantier Creek Resort. All voted Aye. Motion Carried.
Raise: Motion by Craig Heller, second by Dennis Booth, to approve 50¢ - 1 year raise for Highway Assistant, Keva Briggs, effective June 21, 2018. All voted Aye. Motion Carried.
July Commission meeting will be conducted Tuesday July 10, 2018.
