The regular meeting of the Stanley County Commission was called to order at 5:07 P.M.(CT) by Chairman Dana Iversen with Commissioners Mike Kenzy, Craig Heller and Sonny Harrowa present. Commissioner Dennis Booth was absent. Also present were State’s Attorney Tom P. Maher, Treasurer Peggy Dougherty, Deputy Treasurer Susan Freeman, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, County Health Nurse Jody Spangenberg, Risty Benefits Sonja Nordbye and Roger Risty, Bill Shrader, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Deputy Treasurer Susan Freeman presented the Commissioners with the Treasurer Report, April 2021 bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the April 2021 Budget Expenditure Report showing each department’s expenses as of April 30, 2021, Fiscal Revenue Report as of April 30, 2021, and Outstanding Disbursements by Account as of June 1, 2021.
Risty Benefits: Sonja Nordbye presented the Commissioners with options for county employee health and life insurance. Sonja explained that Risty Benefits works hard to bring the richest benefit package at the lowest price possible. Risty Benefits is committed to the clients, not the insurance company.
County Health Nurse: Jody Spangenberg introduced herself to the Commissioners. Jody is the new County Health Nurse. Jody is in the office Monday and Friday 8AM to 12PM and Wednesday 8AM to 5PM.
Bill Shrader introduced himself as a fairly new rural Stanley County resident. He voiced his opinion regarding the pending change to the structure of the Stanley County Government, referring to Ordinance 2021-01 Combining the offices of Auditor, Treasurer and Register of Deeds. Bill feels that this change would take away voters right to chose these elected officials. Bill called this change a reduction in the power that you, the voting taxpayer currently has.
Fairgrounds – Scott Deal informed the Commissioners that the new handrails are installed on the bleachers. Scott and his crew are busy getting everything ready for SD State High School Rodeo.
Gutters: This has been tabled. The Commissioners would like to make sure all the quotes received for the new gutters on the Schomer Barn are the same gauge and they all include snowguards.
Highway Department: Lee Smith presented to the Commissioners a report of work performed by the Highway Department for the month of May 2021, which consists of hauling screened gravel to Nash Loop, Bobby Stoeser Road, Mike Norman Road, laying gravel, blading Sansarc Road, Bad River Road, Scotty Philips Road, Frontier Road, Hayes Road, Three Mile Road, Frank Turner Road, Wendt Road, Donahue Road, Reuer Ranch Road, Carlisle Road, Mission Ridge Road, Cheyenne School Road, Marvin Olson Road, B&B Ranch Road, S Brown Church Road, Walker Road, Minneconjou Road, Just Anderson Road, Minneconjou Bay, Ancel Tibbs Road, Ancel Tibbs Ranch Road, Sylvia Huckfeldt Road, Fluharty Road, Meyers Road, Bear Camp Road, Slaathaug Road, War Creek Road, Gaylord Norman Road, Max Jones Road, Rose Road, Rose Ranch Road, Verendrye Road, Clark Alleman Road, Ray McQuistion Road, Stroup Ranch Road, Casey Hannum Road, Norm Stoeser Road, Tower Road, N Brown Church Road, Triple U Ranch Road, Holland Ranch Road, cleaning drainage on Max Hlebanja Road and working on equipment.
Lee Smith spoke to Mid Dakota Vegetation regarding the right-of-way spraying. Mid Dakota will spray the weeds for $27.50 per mile with 10’ rows.
Resolution 2021-12 – Register of Deeds Monthly Fee Date: Motion by Sonny Harrowa, second by Mike Kenzy, to approve Resolution 2021-12-Register of Deeds Monthly Fees Due to the County Treasurer by the 15th of each month. All voted Aye. Motion Carried.
RESOLUTION 2021-12
A RESOLUTION APPROVED at a meeting of the Board of Stanley County Commissioners, on the 1st day of June, 2021, setting the Office of Register of Deeds deposit of fees and other collections received due to the County Treasurer by the 15th of each month.
WHEREAS, SDCL 7-9-17, within the time frame established by the County Commission, the Register of Deeds shall deposit with the County Treasurer the total amount of fees and other collections received. Unless otherwise required, all fees and other collections shall be placed to the credit of the General Fund. At the discretion of the Register of Deeds, fees and other transactions may be charged on account but shall be collected by the end of the following month. The Register of Deeds shall maintain a detailed record of any accounts receivable.
BE IT RESOLVED that the County Commission, in and for Stanley County, does hereby approve the deposit of fees and other collections received by the Office of Register of Deeds due to the County Treasurer by the 15th of each month.

Resolution 2021-13 – Drought Disaster Declaration: Motion by Sonny Harrowa, second by Craig Heller, to approve Resolution 2021-13-Drought Disaster Declaration. All voted Aye. Motion Carried.

Drought Disaster Declaration
WHEREAS, Stanley County continues to suffer from a natural disaster in the form of severe agricultural drought conditions, including extremely inadequate winter snowfall, meager spring rains, desolating winds accompanied with high temperatures and late frosts which have severely impacted all drought conditions, the Board of County Commissioners resolve that said drought conditions constitute a natural disaster of such severity and magnitude that an effective response is beyond the capabilities of this County, or even the State of South Dakota, and that Federal assistance is necessary, and there is no emergency plan available to alleviate the damage and economic chaos resulting from these conditions; and
WHEREAS, Stanley County does not have the financial resources to respond to this disaster; and
WHEREAS, the Board of County Commissioners of Stanley County is aware sparse pastures and lack of forage crops for the feeding of livestock is necessitating the reduction/disposal of livestock herds; and
WHEREAS, the Board of County Commissioners of Stanley County is aware that fall and spring planted small grains are already stressed from lack of rain and yields will be impacted; and
WHEREAS, the Board of County Commissioners of Stanley County realizes that an emergency has resulted from a lack of water in the agriculture community and the quality of water in stock ponds due to extreme low runoff, which could result in a high selenium concentration and livestock mortality,
WHEREAS, the Board of County Commissioners of Stanley County is aware that in addition to these conditions, the continuing drought conditions introduce a new element of synergism compounding the magnitude of devastation to our agricultural infrastructure,
NOW THEREFORE BE IT RESOLVED, the Board of County Commissioners of Stanley County, South Dakota, declares a natural disaster drought emergency; and it is
FURTHER RESOLVED, we, the Board of Commissioners of Stanley County respectfully petition the Governor of the State of South Dakota and the President of the United States to provide with all dispatch and remedies any state and/or federal assistance available for this type of emergency.
Commissioner Sonny Harrowa moved to adopt said resolution and Commissioner Craig Heller seconded the motion.

New Hire – Deputy Register of Deeds: Motion by Sonny Harrowa, second by Craig Heller, to approve the hire of Patricia Duffy as Deputy Register of Deeds, starting salary of $45,000.00, with a $2,500.00 salary increase once Patricia Duffy is appointed Register of Deeds, and another salary increase in an amount to be determined 6 months after appointment, plus any cost-of-living increase approved by Commission for all county employees, including benefits. Exact start date is to be determined, July 2021. All voted Aye. Motion Carried.
County Health Nurse Administrative Assistant: Bonnie Nickels submitted her retirement/resignation effective June 4, 2021, after 41 ½ years as County Health Nurse Administrative Assistant.
Executive Session – Personnel – SDCL 1-25-2(1): Motion by Mike Kenzy, second by Craig Heller, to go into Executive Session-Personnel-SDCL 1-25-2(1) at 7:07 PM. All voted Aye. Motion Carried.

Discussion: The Stanley County Commission will have a Special Meeting Tuesday June 15, 2021, at 5:00 P.M., for the First Reading of A Temporary Ordinance Regarding the Issuance of Local Medical Cannabis Establishment Permits and/or Licenses.
