July 8, 2025
The regular meeting of the Stanley County Commission was called to order at 5:10 P.M. (CT) by Chairman Craig Heller with Commissioners Mike Kenzy, Dana Iversen, Sonny Harrowa and Gary Grittner. Also present was State’s Attorney Tom P. Maher, Treasurer Bill Konst, Deputy Director of Equalization Jodi Bothwell, Highway Superintendent Lee Smith, Hughes/Stanley County Emergency Management AJ Rounds, Central SD Enhancement District David Reiss, Public Utilities Commission Chris Nelson, Larry McQuistion, Don Kirkpatrick, David K. Treasurer Report: Treasurer Bill Konst informed the Commission of interest earned for June 2025 is $11,871.44, Wheel Tax collection is $10,987.24, and delinquent taxes to be collected is $38,638.78.
Auditor Report: Auditor Philena Burtch presented the Commissioners with the Budget Expenditure Report showing each department’s expenses as of May 31, 2025, and Outstanding Disbursements as of July 8, 2025.

Public Utilities Commission: Chris Nelson informed the Commission that the PUC has siting authority for wind farms with a capacity of 100 megawatts or more, these projects are required to obtain a permit from the PUC before construction can begin. Small wind projects are not regulated by the PUC.
Per SDCL 49-41B-22, “The applicant has the burden of proof to establish by preponderance of the evidence that the proposed facility will comply with all applicable laws and rules, the facility will not pose a threat of serious injury to the environment nor to the social and economic condition of inhabitants or expected inhabitants in the siting area. An applicant for an electric transmission line, a solar energy or a wind energy facility that holds a conditional use permit from the applicable local units of government is determined not to threaten the social or economic condition of inhabitants or expected inhabitants in the siting area. The facility will not substantially impair the health, safety or welfare of the inhabitants or expected inhabitants in the siting area. The facility will not substantially impair the health, safety or welfare of the inhabitants, and the facility will not unduly interfere with the orderly development of the region with due consideration having been given the views of governing bodies of affected local units of government. An applicant for an electric transmission line, a solar energy facility or a wind energy facility that holds a conditional use permit from the applicable local units of government is in compliance with this subdivision.”
The application process takes around nine months. All forms of divisions are contacted for concerns to make sure the project area is suitable; Game Fish & Parks, Historical Preservation Society, DANR, etc. Sound should not be more than 45 decimals and shadow flicker should not be more than thirty minutes. Reclamation is very important when a siting is decommissioned, an escrow account is required, a certain amount of money per site with the stipulation of the reclamation being complete within one year of decommissioning.
4-H Kids: Joseph, Henry, Marshall, Jonathan, Justin, and Katie informed the Commission about their models, Lego projects, visual arts, photography, livestock, goats and their best showmanship and sportsmanship awards they each have received this year. Crystal Neuharth thanked the Commission for the continued support of the 4-H program, it is greatly appreciated.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of June 2025, which consists of hauling gravel, blading, mowing, service and maintain equipment. Lee informed the Commission that the price to rent the mowing tractors is going up next year.
2006 Challenger Tractor: Lee explained that he is looking in a different directing for a tractor for the scraper.
Blanket Speed Limit Resolution: Lee explained that the County needs to have a blanket speed limit resolution for 45mph or 50mph, unless otherwise posted. This resolution will be drawn up and presented later.
Gross Weight Limit Resolution: Lee emphasized that a gross weight limit resolution needs to be put in place, 1 unit, set at 80,000 lbs., include fines. The heavy loads and the trucks pulling double trailers are tearing up the county roads. This resolution will be drawn up and presented once it is reviewed by the legal department.
Bad River Ranches Powell Creek Bridge Right-of-Way: Motion by Gary Grittner, second by Mike Kenzy, to accept and approve Chairman Heller to sign Easement Packet for Voluntary Right-of- Way Donation in accordance with SD DOT Project number BRF 6450 (00) PCN 08RR, Powel Creek Bridge replacement, on Bad River Road, Stanley County. All voted Aye. Motion Carried.
LTAP Motorgrader Training: Lee Smith informed the Commission that LTAP would be conducting a motorgrader training at the county shop on July 9, 2025 at 7:00 A.M. Other counties will be attending.

FORMAL SUPPLEMENTAL BUDGET
WHEREAS it is necessary to supplement the 2025 Annual Budget in order to carry on the indispensable functions of Stanley County; and
WHEREAS, the adoption of the proposed Supplemental Budgets were duly considered by the Stanley County Commission on the 8th day of July, 2025, in the Commission Room, pursuant to due notice; therefore, be it
RESOLVED by the Stanley County Commission that the following Supplement Budgets be, and the same is, hereby approved for the purpose of providing budget to conduct the indispensable functions of Government, to wit:
