July 7, 2022
The regular meeting of the Stanley County Commission was called to order at 5:05 P.M.(CT) by Chairman Dana Iversen with Commissioners Dennis Booth, Mike Kenzy, Craig Heller and Sonny Harrowa. Also present were State’s Attorney Tom P. Maher, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, Register of Deeds Patti Duffy, Director of Equalization Tracy Schmitt, Cody Briggs, Lila Briggs, Donnie Edwards, Nichole Edwards, Attorney Ellie Bailey, Terri Heninger, Fort Pierre Livestock Bryan Hanson and Dennis Hanson, Fort Pierre Fire Department Justin Jones, Tye Odden and Rick Cronin, Capital Journal Gwen Albers and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer & Auditor Report: Auditor Burtch presented the Commissioners with the Treasurer Report, May 2022 bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the May 2022 Budget Expenditure Report showing each department’s expenses as of May 31, 2022.

Register of Deeds: Patti Duffy presented planned modernization and preservation expenditure projects to the Commission. Patti explained that she would like to use the ROD M&P Fund for two projects and to purchase a bigger scanner for the bigger Plats. The microfilm project would consist of coping all recorded documents from 2008 to present onto microfilm at a cost of $2,000.00. Preparation for Electronic Back-up Program, or E-Share Secure, would consist of conversion and inspection of existing images, installation of the program and training, at a cost of $2,275.00. And a one-time purchase and installation of a 24” scanner for Plats at a cost of $3,850.00.
Microfilm Project: Motion by Dennis Booth, second by Craig Heller, to approve Register of Deeds Microfilm Project, not to exceed $2,000.00. All voted Aye. Motion Carried.
Electronic Back-Up – E-Share Secure: Motion by Sonny Harrowa, second by Mike Kenzy, to approve Register of Deeds E-Share Secure Program in the amount of $2,275.00. All voted Aye. Motion Carried.
Scanner: Motion by Craig Heller, second by Sonny Harrowa, to approve the purchase of a 24” scanner from Microfilm Imaging Systems Inc, in the amount of $3,850.00. All voted Aye. Motion Carried.
Director of Equalization – Tracy Schmitt: Resolution 2022-18 Plat of Briggs Lot 5 & Lot 6
Ellie Bailey, attorney for Mr. Turner, adjoining land owner, stated that Mr. Turner has an issue with the approach off Highway 14/34. Ms. Bailey stated that Briggs Lot 5 will not have highway access. Cody Briggs stated that access to Briggs Lot 5 will be on the north side across Briggs Lot 6.
Motion by Sonny Harrowa, second by Craig Heller, to approve Resolution 2022-18 Plat of Briggs Lot 5 and Lot 6. All voted Aye. Motion Carried.

Planning & Zoning Board Pay Raise: Motion by Craig Heller, second by Sonny Harrowa, to approve Planning & Zoning Board Pay Raise from $41.20 per meeting to $51.50 per meeting, effective July 1, 2022. All voted Aye. Motion Carried.
Fort Pierre Livestock – Waste Burn Pile: Dennis Hanson and Bryan Hanson are open to suggestions regarding the smoldering waste pile. Dennis stated that in 75 years, this is the first time they have had this type of issue. No, this was not set on fire on purpose. No, they are not adding more waste to the smoldering pile. The Commission spoke to the State about the pink foam. The pink foam is not good for the water. The fire department stated that it has a good road berm around it and with all the moisture, things are green. The pile is isolated and is being monitored daily. At this point it is better to leave it alone, let it smolder itself out. If they dig into it, it could ignite and create a thick smoke for a longer time.
Fairgrounds: Scott Deal informed the Commissioners that the South Dakota State High School Rodeo went well. Scott had to have the highway department remove all the sand from the cutting arena and replace it with different sand. Thank you to Lee and the Highway Department for doing this. Scott informed the Commission that 342 contestants participated in this year’s state high school rodeo.
Scott Deal informed the Commissioners that with all the rain, the 4th of July Rodeo went well also. They had some of the fastest times in barrel racing during the July 3rd performance. The rodeo had a good show of contestants and attendance.
Scott Deal informed the Commissioners that the new water truck works the way they need it to. The next big event is the Wrangler Roping. Last year there was 800 teams.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of June, 2022, which consists of blading, hauling gravel, mowing, weed control, fill cuts and washouts on Bad River Road, War Creek Road and Bob Calkins Sr Road and service and maintenance of equipment. Lee stated that all the rain has been good for the county roads. The highway department has been able to work and shape the roads.
Lee Smith received a complaint about Canadian thistle. Lee spoke to the property owner. The property owner stated they will be mowing within the week.
Gasoline Tank: Motion by Dennis Booth, second by Craig Heller, to approve the purchase of a 1,000-gallon gasoline tank from CHS in the amount of $2,200.00. All voted Aye. Motion Carried.
Resignation: Motion by Sonny Harrowa, second by Craig Heller, to accept the resignation of Highway Department Nathan McMillin, effective June 2, 2022. All voted Aye. Motion Carried.
Treasurer Resignation: Motion by Sonny Harrowa, second by Craig Heller, to accept the resignation to retire of Treasurer Peggy Dougherty effective June 21, 2022. All voted Aye. Motion Carried.
Deputy Treasurer/Deputy Auditor New Hire: Motion by Dennis Booth, second by Mike Kenzy, to approve the hire of Deputy Treasurer/Deputy Auditor Kaylee Green effective July 5, 2022, starting pay of $16.50 per hour, with three (3) 50¢ per hour raises; one at 6 months, one at 12 months and one at 18 months, with supervisor approval, plus any cost-of-living increase approved by Commission for all County employees, including benefits. All voted Aye. Motion Carried.
County Employee Health Insurance: Motion by Dennis Booth, second by Craig Heller, to accept Risty Benefits proposal of Avera Health Plan with $1,500.00 deductible for County Employee Health Insurance, effective August 1, 2022. All voted Aye. Motion Carried.
Automatic Budget Supplement – Weed & Pest, Fairgrounds and Road & Bridge: Motion by Mike Kenzy, second by Sonny Harrowa, to approve Automatic Budget Supplement, in the amount of $5,660.85, for Weed & Pest Equipment, to reflect the sale of surplus property 1984 Ford 6610 Tractor. All voted Aye. Motion Carried.
