July 6, 2021
The regular meeting of the Stanley County Commission was called to order at 5:12 P.M.(CT) by Chairman Dana Iversen with Commissioners Mike Kenzy, Craig Heller and Sonny Harrowa present. Commissioner Dennis Booth was absent. Also present were Deputy Treasurer Susan Howard, Highway Superintendent Lee Smith, Prairie Winds 4-H Levi, Crystal, Jonathan, Justin and Katie Neuharth, SD Department of Transportation Dean VanDeWiele, US Army Corps of Engineers Jason Taylor, Cove Place Road District Bill Konst and Jeff Konst, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Deputy Treasurer Susan Howard presented the Commissioners with the Treasurer Report, May 2021 bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the May 2021 Budget Expenditure Report showing each department’s expenses as of May 31, 2021, Fiscal Revenue Report as of May 31, 2021, and Outstanding Disbursements by Account as of July 6, 2021.
Prairie Winds 4-H: Crystal Neuharth introduced herself and her family, she also thanked the Commissioners for their continued support of the 4-H programs. Crystal informed the Commission that 4-H Achievements Days will be held only one day this year, Monday August 2, 2021.
Jonathan Neuharth is 13 years old and is a Junior in 4-H. Jonathan informed the Commission that he does Public Presentation, Grasslands, shows livestock, he is planning to show 5 chickens and 10 goats at State Fair. Jonathan explained that 4-H also does static projects, photo, arts and welding. He also attends Western Junior Showing with his chickens and goats. Jonathan showed the Commission his box of ribbons and plaques that he has been awarded just in the last year.
Justin Neuharth is 10 years old. Justin explained to the Commission about the process of pressing plants. Justin is planning to show chickens and 10 goats at State Fair this year also. Justin showed the Commission his box of ribbons and plaques that he has been awarded just in the last year.
The Commission thanked Jonathon and Justin for coming in to speak about 4-H, sharing their experience and for their hard work.
SD Department of Transportation: Dean VanDeWiele explained to the Commission that the US Army Corps of Engineers will need to close SD Highway 1806 from Cut-Across Road east to West Bull Road to repair the spillway. Jason Taylor with the US Army Corps of Engineers explained that a crane will sit on SD Highway 1806 to be used for the repair. This section of the highway will be open at night. The project should only take 2-3 days. Dean explained that US Army Corps of Engineers’ permit to close SD Highway 1806 is from August 30-September 10, 2021. The State DOT, US Army Corps of Engineers and Stanley County will inform the public of closures as the project date approaches.
Dean VanDeWiele informed the Commission of the chip seal project for US Highway 14/34 from the US Highway 14/34 and SD Highway 1806 Junction west to Prince Hills will begin in August, after the Sturgis Rally. Dean also informed the Commission of a two-year project south on SD Highway 1806. The first year will consist of replacing a pipe, the second year will consist of paving.
Cove Place Road District: Bill Konst and Jeff Konst informed the Commission that Cove Place Road District has been having issues with a land owner, whose land has never been part of Cove Place Road District.
The Commission explained that since Cove Place Road District is recognized as a governmental subdivision of the State of South Dakota effective August 15, 2011, has established a governing board and by-laws, the road is not in conformance with State or County specifications and the road has been built and is being maintained solely by Cove Place Road District, the County has no jurisdiction over this matter.
Highway Department: Lee Smith presented to the Commissioners a report of work performed by the Highway Department for the month of June 2021, which consists of hauling gravel, blading, replace culvert on Nash Loop, Guy Doty Road, mow right-of-way’s, fill cuts and washouts on B&B Ranch Road, clean drainage on Nash Loop Road, Minneconjou Road and Hayes Road and working on equipment.

Lee Smith informed the Commission that the new cab for the 2014 Freightliner has been delivered and the highway department is almost finished putting it on the frame and connecting the hoses and wires. The truck is almost ready to go to Floyd’s Truck Center for the finishing touches.
Lee Smith informed the Commission that the Stanley County Weed & Pest Board served a Volunteer Compliance letter regarding the spread of Canadian Thistle to a land owner. SDCL 38-22-23.13 was sited, Resolution of board confirming and stating remedial requirements—Service on owner. Lee stated that a few of the Stanley County Weed & Pest Board members and SD Department of Agriculture Weed Management met with the land owners to discuss the land owners plan to control this noxious weed.

A TEMPORARY ORDINANCE REGARDING THE ISSUANCE OF LOCAL MEDICAL CANNABIS ESTABLISHMENT PERMITS AND/OR LICENSES
WHEREAS, a local government may enact an ordinance not in conflict with SDCL Chapter 34-20G, governing the time, place, manner, and number of medical cannabis establishments in the locality. A local government may establish civil penalties for violation of an ordinance governing the time, place, and manner of a medical cannabis establishment that may operate in the locality. A local government may require a medical cannabis establishment to obtain a local license, zoning permit, or registration to operate, and may charge a reasonable fee for the local license, zoning permit, or registration.
WHEREAS, Stanley County, SD (“County”), makes a preliminary finding that the County’s current regulations and controls may not adequately address the unique needs and impacts of medical cannabis establishments as defined in SDCL 34-20G-1;
WHEREAS, medical cannabis state laws under SDCL 34-20G are effective July 1, 2021. The South Dakota Department of Health shall promulgate rules pursuant to chapter 1-26 not later than October 29, 2021, as defined by SDCL 34-20G-72. During the time between July 1, 2021 and potentially as late as October 29, 2021, local units of government will not yet know standards for medical cannabis and will not be able to adequately assess the local zoning and licensing requirements necessary to approve local permits and to better ensure applicants have a more predictable permitting process and avoid stranded investments.
WHEREAS, the County makes a preliminary finding that the County needs further study of the relationship of medical cannabis establishments to the County Comprehensive Plan and Zoning Ordinance. The public interest requires that the County study, analyze, and evaluate the impacts of medical cannabis establishments and to fully explore the impacts of any proposed regulations regarding medical cannabis establishments;
WHEREAS, the County makes a preliminary finding that it would be inappropriate for the County to issue a local permit or license to a medical cannabis establishment prior to the South Dakota Department of Health’s promulgation of regulations governing the same;
WHEREAS, the County hereby exercises its authority under SDCL 11-2-10 and SDCL 7-18A-8, to establish a temporary ordinance regarding the issuance of any local permits/licenses for medical cannabis establishments within the County;
WHEREAS, a temporary ordinance will ensure that more comprehensive zoning ordinance and building permit changes, licensing permits, and any proposed amendments to the County’s Comprehensive Plan can be completely examined with adequate public input from citizens, business interests, and medical cannabis industry representatives;
WHEREAS, the County finds that a temporary ordinance is reasonable to preserve the status quo and prevent significant investment pending the outcome of the above study and any proposed regulations emanating therefrom;
WHEREAS, the County finds that the following ordinance is necessary to protect and immediately preserve the public health, safety, welfare, peace and support of the county government and its existing public institutions;
NOW, THEREFORE, BE IT ORDAINED BY Stanley County, SD:
Section 1. Temporary Ordinance – Application for Local Permit/License
A medical cannabis establishment desiring to operate in the County shall be required to apply for a permit and/or license from the County. Applications for a local permit and/or license to operate a medical cannabis establishment, as defined by SDCL 34-20G-1, shall not be accepted until the South Dakota Department of Health has promulgated regulations as required by SDCL 34-20G-72. Any application received prior to such regulations being promulgated shall be denied.
Section 2. Immediate Effect.
This ordinance is necessary to protect and immediately preserve the public health, safety, welfare, peace, and support of the county government and its existing public institutions pursuant to SDCL 11-2-10 and SDCL 7-18A-8.

Resolution 2021-14 – Off-Sale Liquor Licenses: Motion by Craig Heller, second by Mike Kenzy, to approve Resolution 2021-14, Off-Sale Liquor Licenses. All voted Aye. Motion Carried.
RESOLUTION 2021-014
WHEREAS, the Legislature of the State of South Dakota has provided for the approval of package off-sale liquor by the boards of the county commissioners of the counties of said State pursuant to SDCL Title 35 as amended; and
WHEREAS, SDCL 35-4-11.1 as amended provides that the board of county commissioners shall on or before the second of September in each year determine by ordinance or continuing resolution the number of packet off-sale liquor licenses (other than malt beverage) it will approve for the ensuing calendar year and the fees to be charged for the various classifications of licenses; and
WHEREAS, the Stanley County Board of County Commissioners has set the number of packaged off-sale liquor licenses at two (2) and the fee for such license at $300; and
WHEREAS, the Stanley County Board of Commissioners wishes to the make the license available to the public on a first-come, first-serve basis; and
WHEREAS, no county off-sale license may be issued for a retailer located within three (3) miles of the exterior boundary of an incorporated municipality.
NOW, THEREFORE, BE IT HEREBY RESOLVED that the Stanley County Commission makes the following rules applicable to the issuance of the new package off-sale liquor licenses:
1. Applicants may apply for the package off-sale liquor license beginning upon passage of 2021 Senate Bill 152.
2. Such application packet shall include the following:
a. Uniform Alcoholic Beverage Application. This must be completed fully and according to its instructions, and bear the necessary original signatures.
b. License Purchase Fee. License purchase fee in the amount of $300 shall be presented at time of application.
3. In the event the first come, first-serve application is not able to meet the licensing
standards set out by SDCL Chapter 35-2, the applicant who next submits a fully and
accurately complete application shall be next considered.
