January 4, 2022

The regular meeting of the Stanley County Commission was called to order at 5:00 P.M.(CT) by Chairman Dana Iversen with Commissioners Dennis Booth, Mike Kenzy, Craig Heller and Sonny Harrowa present. Also present were State’s Attorney Tom P. Maher, Treasurer Peggy Dougherty, Deputy Treasurer Susan Howard, Gary Grittner, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Auditor Burtch requested to Amend the Agenda by adding Bad River Road Structure No. 59-219-391 Invitation to Bid.

AGENDA: Motion by Sonny Harrowa, second by Dennis Booth, to approve the Amended Agenda. All voted Aye. Motion Carried.

MINUTES:  Motion by Mike Kenzy, second by Dennis Booth, to approve December 7, 2021, Minutes, December 21, 2021 Minutes and December 30, 2021 Minutes. All voted Aye. Motion Carried.

Conclude 2021’s Business: All business having been transacted for 2021, Motion by Sonny Harrowa, second by Craig Heller, to adjourn Business for 2021 at 5:01 P.M.

Treasurer Report: Treasurer Peggy Dougherty presented the Commissioners with the Treasurer Report, November 2021 bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments, Money Market reports and a detailed report of delinquent real estate taxes as of January 3, 2022.

Treasurer – Titles of Dakota: Motion by Sonny Harrowa, second by Craig Heller, to approve the hire of Titles of Dakota for research of parcels; First parcel search is $100.00, additional parcels per same owner is $75.00, not to exceed $400.00 per property owner. All voted Aye. Motion Carried.

Executive Session-Personnel-SDCL 1-25-2(3): Motion by Sonny Harrowa, second by Craig Heller, to go into Executive Session-Personnel-SDCL 1-25-2(3) at 5:12 P.M. All voted Aye. Motion Carried.

Chairman Iversen declared to reconvene at 5:34 P.M.

Temporary Hire: Motion by Craig Heller, second by Dennis Booth, to approve the temporary hire of Jane Naylor, at $45.00 per hour, to assist the Treasurer with Tax Deeds, not to exceed $1,500.00. All voted Aye. Motion Carried.

Auditor Report: Auditor Philena Burtch presented the Commissioners with the November 2021 Budget Expenditure Report showing each department’s expenses as of November 30, 2021 and Fiscal Revenue Report as of November 30, 2021.

Lieberman/FEMA Hazard Mitigation Grant: Motion by Dennis Booth, second by Sonny Harrowa, to deny to sponsor a FEMA Hazard Mitigation Assistance Grant for hazard mitigation project at the Lieberman property located on SD Highway 1806. All voted Aye. Motion Carried.

2022 Brule County Jail Contract: Motion by Sonny Harrowa, second by Craig Heller, to accept and approve Chairman Iversen to sign the 2022 Brule County Jail Contract; $60.00 per day for per in-custody. All voted Aye. Motion Carried.

Capital Area Counseling Service Inc Mobile Crisis Response Agreement: Motion by Craig Heller, second by Mike Kenzy, to accept and approve Chairman Iversen to sign the Capital Area Counseling Service Inc. Mobile Crisis Response Agreement; $200.00 per day for on-call time, $225.00 per hour for face-to-face assessment, $125.00 per day for follow-up service. All voted Aye. Motion Carried.

TextMyGov Messaging App: Motion by Mike Kenzy, second by Dennis Booth, to deny the purchase of TextMyGov Messaging App for Stanley County. All voted Aye. Motion Carried.

Board Appointments: All boards to remain the same as CY2021.

Designation of Official Places of Sale: Motion by Craig Heller, second by Sonny Harrowa, to designate the Courthouse, Fairgrounds and the County Highway Shop as official places of sale for Stanley County. All voted Aye. Motion Carried.

Department Purchase Policy: Department purchase policy is all Departments need approval for purchase over $500.00, the Highway Department needs approval for fuel purchase over $15,000.00.

RESOLUTION 2022-03

DESIGNATING OFFICIAL NEWSPAPER

WHEREAS, the law requires that an official newspaper be designated for the county.

NOW THEREFORE BE IT RESOLVED by the Board of Stanley County Commissioners that the official newspaper for Calendar Year 2022 shall be the Capital Journal.

Resolution 2022-04 Burial and Funeral Assistance: Motion by Sonny Harrowa, second by Dennis Booth, to adopt Resolution 2022-04 Burial and Funeral Assistance. All voted Aye. Motion Carried.

RESOLUTION 2022-04

BURIAL AND FUNERAL ASSISTANCE

For those County residents who die in a state of indigence or who are otherwise qualified under SDCL 28-17

BE IT RESOLVED that Stanley County shall allow burial and funeral expenses as follows:  Two Thousand Dollars ($2,000.00) burial fees and the opening and closing of the grave.

Any requests for County burial assistance shall be made prior to the services, whenever practical.  It shall be the duty of the Commissioner in whose district the decedent had established residency to determine if the resident was indigent at the time of death, if it is not possible for the entire Board to meet prior to the time of the internment.

BE IT FURTHER RESOLVED that the Stanley County Commissioners will follow all guidelines set out in Stanley County’s Welfare Guidelines for burial assistance as per Chapter 13 of the Welfare Guidelines for Stanley County.

BE IT FURTHER RESOLVED that the aforementioned amounts shall be for the Calendar Year 2022.

Resolution 2022-05 Claims: Motion by Craig Heller, second by Sonny Harrowa, to adopt Resolution 2022-05 Claims. All voted Aye. Motion Carried.

RESOLUTION 2022-05

CLAIMS

WHEREAS certain entities require the payment of funds by the 15th day of each month or payment within a certain time frame; and

WHEREAS many of these claims are received after the Board of Commissioners’ monthly meeting; and

WHEREAS interest or a penalty might apply if these claims are not paid within the specified time;

NOW, THEREFORE BE IT RESOLVED that the County Auditor is hereby given the authority to pay such claims without the Commissioners’ approval providing the claims are presented at the next regular meeting of the Board of County Commissioners.

Resolution 2022-06 Travel and Conference: Motion by Craig Heller, second by Mike Kenzy, to adopt Resolution 2022-06 Travel and Conference. All voted Aye. Motion Carried.

RESOLUTION 2022-06

TRAVEL AND CONFERENCE

WHEREAS County Commissioners, Auditor, Register of Deeds, Treasurer, State’s Attorney, County Coroner, Director of Equalization, Highway Superintendent, and Assistants and/or Deputies as determined by Elected Official or Department Head, are hereby authorized to attend educational conferences, meetings and conventions held and conducted within or without the State of South Dakota pertaining to the betterment and advancement of County government per SDCL 7-7-25; and          

WHEREAS the Stanley County Board of Commissioners has set the mileage and conference expense for the county offices;           

NOW, THEREFORE, BE IT RESOLVED that Stanley County will pay up to $40.00 per day for meals.  Meals are reimbursed when overnight travel is required at $6.00 for breakfast (leaving before 5:31 a.m.; returning after 7:59 a.m.); $14.00 for lunch (leaving before 11:31 a.m.; returning after 12:59 p.m.); and $20.00 for dinner (leaving before 5:31 p.m.; returning after 7:59 p.m.).  There shall be no reimbursement for meals when they are provided as part of the meeting.  Mileage for personally owned vehicle shall be at the state rate of $0.42 per mile.  Motel rooms shall be paid at actual cost.

Resolution 2022-01 Salaries and Wages: Motion by Craig Heller, second by Mike Kenzy, to approve Resolution 2022-01 Salaries and Wages, effective the first payroll of 2022. All voted Aye. Motion Carried.

SALARY RESOLUTION 2022-01

WHEREAS, SDCL requires the Board of County Commissioners to designate the number of Deputies and Clerks and to set their salaries.

THEREFORE, BE IT RESOLVED by the Board of Stanley County Commissioners, that the salary of all new employees be set upon hiring.  Judges and Clerks of Elections, $15.00 per hour, $15.00 for Election School, plus mileage for rural Election workers; Mileage reimbursement rate for personally owned vehicle for all county employees, 42 cents per mile; Commissioners have the option of participation in the health insurance plan at their own expense. 

BE IT FURTHER RESOLVED that all highway maintenance employees will work four (4), 10-hour days during Daylight Savings Time. All highway maintenance employees will work five (5), 8-hours days during Standard Daylight Time.

Ordinance 2022-01 Re-Districting – Second and Final Reading: As there is no public comment or further discussion, Motion by Sonny Harrowa, second by Craig Heller, to approve and adopt Ordinance 2022-01 Re-Districting. All voted Aye. Motion Carried.

ORDINANCE No. 2022-01

AN ORDINANCE OF STANLEY COUNTY, SOUTH DAKOTA, DEFINING ELECTION DISTRICTS.

BE IT ORDAINED BY STANLEY COUNTY, SOUTH DAKOTA:

Stanley County shall be divided into five commissioner districts, designated respectively as District One, Two, Three, Four and Five. The districts shall be described with certain street or avenue designations or other landmarks that border the districts. Any reference to street or avenue below shall mean an imaginary line running down the approximate middle of each street or avenue. The commissioner districts of Stanley County are as set forth below and shown in the Commissioner District Map thereof. Any discrepancies shall be resolved by reference to the attached Commissioner District map rather than the physical descriptions set forth herein. Any previous Commissioner Districts are replaced by those described herein and on the attached Commissioner District map.

Commissioner District One shall include all of that part of Stanley County lying North of a line beginning at the West limits of the County and running South until intersecting with SD Highway 34; thence running East along SD Highway 34 and US Highway 14 until intersecting with SD Highway 1806; thence following SD Highway 1806 North until intersecting with Fort Chouteau Road; thence following Fort Chouteau Road East until intersecting with Dunes Drive; thence running North and West ending at the Missouri River/Lake Sharpe/Cheyenne River shoreline.

Commissioner District Two shall include all the part of Stanley County enclosed by a line beginning at the intersection of East Main Avenue until intersecting with South Deadwood Street running North along Deadwood Street until intersecting with Fifth Avenue; thence running north along US Highway 83 until intersecting with Skerrols Street; thence running North until intersecting with Port Charlotte Avenue until intersecting with Port-Na-Haven Street; thence running North along Port-Na-Haven Street until intersecting with Caol-Ila Court; thence West on Caol-Ila Court until intersecting with Mull Street until intersecting with Jura Avenue; thence running West on Jura Avenue until intersecting with North Waldron Street; thence running Southwest along Waldron Street until intersecting with US Highway 14; thence running West along US Highway 14 until intersecting with North Buffalo Road running South along Fort Pierre City Limits until intersecting with West Cedar Avenue; thence running East on West Cedar Avenue until intersecting with South Second Street; thence North on South Second Street until intersecting with the Bad River and East toward US Highway 83; thence running North along US Highway 83 until intersecting at East Main Avenue.

Commissioner District Five shall include all the part of Stanley County enclosed by a line beginning at the intersection of the northern limit of Section 9-Township 5 N-Range 31 E and the Missouri River/Lake Sharpe and running West along northern limit of Section 9-Township 5N-Range 31 E until intersecting with Fort Chouteau Road; thence running West along Fort Chouteau Road until intersecting with North SD Highway 1806; thence running south on North SD Highway 1806 until intersecting with US Highway 14; thence running East on US Highway 14 until intersecting with North Waldron Street; thence running North on Waldron Street until intersecting with North Tiree Drive; thence running East on Jura Avenue until intersecting with Iona Street; thence running South on Iona Street until intersecting with Islay Avenue; thence running East on Islay Avenue until intersecting with Skerrols Street; thence running South on Skerrols Street until intersecting with Caol-Ila Court; thence running East on Caol-Ila Court until intersecting with Port-Na-Haven Street; thence running South on Port-Na-Haven Street until intersecting with Port Charlotte Avenue; thence running West on Port Charlotte Avenue until intersecting with US Highway 14; thence running South on US Highway 14 to US Highway 83 until intersecting with East Fifth Avenue; thence running East on Fifth Avenue until intersecting with Missouri Avenue; thence running North on Missouri Avenue until intersecting with Nineth Avenue; thence running East on Nineth Avenue until intersecting with Marion Street; thence running North on Marion Street until intersecting with US Highway 14 East; thence running East on US Highway 14 to the Missouri River/Lake Sharpe; thence running North along the Missouri River/Lake Sharpe ending at northern limit of Section 9-Township 5 N-Range 31 E.
