The regular meeting of the Stanley County Commission was called to order at 5:00 P.M. (CT) by Chairman Craig Heller with Commissioners Mike Kenzy, Dana Iversen, Sonny Harrowa and Gary Grittner. Also present was State’s Attorney Tom P. Maher, Deputy State’s Attorney Anna Maher, Treasurer Bill Konst, Government Building Manager Rick Striker, Fort Pierre Chamber of Commerce Shane Kramme, Deputy Coroner Tiffany Sanchez, John Duffy, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer Report: Treasurer Bill Konst informed the Commission of interest earned for January 2025 is $14,541.67, Wheel Tax collection is $11,551.97, and delinquent taxes to collect is $52,028.41.

Monitoring Compliance: Road and Bridge Secondary Road total revenues for 2024 equal $179,738.34, total expenditures equal $143,135.94; Revenue over Expenditures equal $36,602.40.
Expo Center 2024 Report: Shane Kramme presented the Commission with the 2024 Expo Center Report. Total revenue equal $28,260.42, total expenditures equal $25,050.85. Shane informed the Commission that the Expo Center hosted seventeen separate events over the course of the summer schedule with event length ranging from a half day to a week-long, 2024 was another successful year for the community venue. Shane stated that the Fort Pierre Chamber of Commerce is pleased to report that under the guidance of the Expo Board, our community venue continues to produce positive cash flow while creating additional economic and cultural benefits for our entire community.
Shane Kramme also presented the Commission with the 2024 Verendrye Benevolent Association (VBA) Fort Pierre Horse Racing Review. The Association hosted the 76th year of Fort Pierre Horse Racing under sunny skies October 5-6, 2024, at the Stanley County Fairgrounds. Approximately 2,200 individuals attended the weekend live horse racing event which is intended to be a showcase of competitive equine athletes from within our great state, as well as around the region. A total of 12 races were offered with 59 head of horses competing for $92,000.00 in purses and incentives, which were paid out of the VBA contributing $21,000.00 in total purse structure. The total gross handle wagered upon these 59 head was $82,000.00. This quates to nearly a $1,400.00 average per head being wagered. The VBA paid out $5,500.00 in Jockey Bonuses to 11 riders that fulfilled the requirements set forth by the Presiding Steward, Larry Eliason. The Jockey Bonus is essential to ensure an adequate number of riders participate in our weekend event.
The VBA would like to thank the 40 employees who provide a tremendous effort to ensure the event is successful in all sectors, the sponsors and every individual that contributed to the successful weekend of live horse racing action. Without this continued support and commitment from owners, trainers, jockeys, employees and attendees, it would not be possible to continue the time-honored traditions within our great state. VBA is looking forward, with cautious optimism, to the future of horse racing as the VBA works with the SD Horsemen’s Association to find solutions to the economic challenges that face our in-state industry, our producers and our event.
2024 Coroner Report: Gary Grittner presented the Commission with the 2024 Coroner Report. Gary explained that the coroner is responsible for certifying the cause and manner of death where the deceased is not under the care of a medical professional, or where the death is the result of an accident, homicide, or suicide. In 2024, the coroner was responsible for certifying six such cases.
Gary Grittner recognized and thanked the Deputy Coroners, Jill Richardson, Tiffany Sanchez and Shirley Swanson for their help. They show true community spirit and do a great job while never knowing when they will be called upon.
Discussion: State’s Attorney Tom P. Maher met with the City of Fort Pierre regarding the courthouse east parking lot and the city alley. Brosz Engineering has drawn up a plan to move the alley way. There is a lot of infrastructure and utilities under the existing alley, a big expense to move. The thought is to fix the parking lot and alley way with the existing layout, or proceed with Brosz Engineering plan. No decision was made at the time of the meeting.
Government Building Manager Rick Striker provided the Commission with the blueprints of the courthouse showing where the blockage is located along the drain titles, about three feet in. The Commission asked Rick to get bids for the laser survey to monitor movement of the building.
John Duffy would like the city alley to be fixed to eliminate the drainage issue to his building.
Fairgrounds – 2000 International Water Truck: Motion by Sonny Harrowa, second by Dana Iversen, to accept 2000 International Water Truck repair estimate in the amount of $15,019 and approve Floyd’s Truck Center, Fort Pierre, to complete all necessary repairs. All voted Aye. Motion Carried.
Highway Department – 2025 Bridge Reinspection Program Resolution: Motion by Gary Grittner, second by Dana Iversen, to approve 2025 Bridge Reinspection Program Resolution for use with SDDOT Retainer Contracts and hire Brosz Engineering, Inc. for the inspection work. All voted Aye. Motion Carried.

WILDLAND FIRE DIVISION DESIGNEE
WHEREAS, South Dakota State Law 41-20A-11 states, Assistance in suppression of range fire within county—Reimbursement of expenses. At the request of a board of county commissioners or a person designated by a board of county commissioners for such purpose, the state wildland fire coordinator may assist in the suppression of any range fire within the county. If any assistance provided by the coordinator includes the use of more than six state employees and more than two vehicles, the county to which the assistance is given shall reimburse the coordinator for the reasonable expenses incurred. and;
WHEREAS, pursuant to SDCL 41-20A-11, the South Dakota Wildland Fire Coordinator may assist in the suppression of rangeland fires within the county upon request of a Board of County Commissioners or its designee, and;
WHEREAS, at the time of a fire emergency there is insufficient time to convene the Board of Stanley County Commissioners to make such requests, and;
WHEREAS, the South Dakota Wildland Fire Coordinator has requested that a person(s) be officially designated by the Stanley County Commission to make such requests, and;
WHEREAS, Stanley County is responsible for the reasonable expenses incurred by the South Dakota Wildland Fire Coordinator for the assistance that Stanley County requests as set forth above.
NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Stanley County Board of County Commissioners in and for the County of Stanley, State of South Dakota, the Stanley County Board of County Commissioners and Stanley County Sheriff is hereby designated and authorized to request, on behalf of Stanley County, fire suppression assistance from the state wildland fire coordinator as deemed necessary within Stanley County.
The authority to request assistance as provided shall continue in full force and effect until terminated or modified by resolution of the County of Stanley Board of Commissioners.

Resolution 2025-08 Weight Limit Enforcement: Motion by Dana Iversen, second by Gary Grittner, to approve Resolution 2025-08 Weight Limit Enforcement to impose a weight restriction of six ton per axel, up to 80,000 pounds upon all gravel roads belonging to Stanley County Highway System. All voted Aye. Motion Carried.

WEIGHT LIMIT ENFORCEMENT
WHEREAS, SDCL 32-14-6 says; “Local authorities, including road districts, may by ordinance or resolution prohibit the operation of vehicles upon any highway or impose restrictions as to the weight of vehicles allowed. Such prohibitions or restrictions apply only to vehicles to be operated upon any highway under the jurisdiction of and for the maintenance of which such local authorities are responsible and only if the highway by reason of physical condition, rain, snow, or other climatic conditions will be seriously damaged or destroyed unless the use of vehicles on the highway is prohibited or the permissible weights of the vehicles are reduced. Any local authority enacting any such ordinance or resolution shall erect and maintain or cause to be erected and maintained signs designating the provisions of the ordinance or resolution at each end of that portion of any highway affected by the ordinance or resolution. The ordinance or resolution is not valid unless such signs are erected and maintained.”
WHEREAS, the current climatic conditions are such that temperatures are near or above freezing, ample moisture is present and road damage is occurring; and
WHEREAS, SDCL32-22-24 establishes that February fifteenth to April thirtieth is the normal period spring load limits; and
WHEREAS, the county finds it to be in the best interest of public safety to reduce load limits earlier than those found in SDCL 32-22-24; and
WHEREAS, the commissioners of Stanley County, desires to protect existing Stanley County roads, ultimately saving tax dollars, and
NOW THEREFORE BE IT RESOLVED that the commissioners of Stanley County hereby impose a weight restriction of six (6) ton per axel up to eighty thousand pounds (80,000) upon all gravel county roads belonging to the Stanley County Highway System and to declare an emergency.
BE IT FURTHER RESOLVED that this action does not include any federal, state, or municipal roadways.
BE IT FURTHER RESOLVED that the Stanley County Highway Superintendent is directed to promptly erect appropriate signage so that motorists will be so notified.
BE IT FURTHER RESOLVED that the County of Stanley shall request the South Dakota Highway Patrol Officers to enter the County of Stanley with scales adequate to weigh motor vehicles to ensure compliance with State Laws pertaining to vehicle weight and with the weight laws established by this resolution.

RESOLUTION AUTHORIZING APPLICATION FOR FEMA HAZARD MITIGATION ASSISTANCE GRANT PROJECT – GEOLOGICAL SURVEY, North of SD Highway 1806 and South of Lake Oahe
WHEREAS, Stanley County, in cooperation with the Central South Dakota Enhancement District, shall prepare an application for a Hazard Mitigation Assistance Grant in request for a geological survey, a four (4) mile portion of land, North of South Dakota Highway 1806 and South of Lake Oahe, Stanley County, South Dakota: and
WHEREAS, Stanley County verily believes that the subject Hazard Mitigation Project meets and exceeds the requirements for a FEMA project; and
WHEREAS, Stanley County verily believes that the subject Hazard Mitigation Project would reduce future damage to the subject property due to further sliding and otherwise improve the quality of life for residents; and
NOW THEREFORE BE IT RESOLVED that the Stanley County Board of County Commissioners hereby authorized and directs that the County’s Auditor, serve as an application agent, and apply for submittal the subject property with a 25% local match to be made by the County, concerning the four-mile portion of land, North of South Dakota Highway 1806 and South of Lake Oahe and expresses its willingness to apply for and seek the above-referenced hazard mitigation grant.
The Chairman and Auditor are authorized to execute any and all documents necessary to apply for the subject FEMA Hazard Mitigation Grant. The County reserves its right to approve or deny the project, in the event that the goal of the application be obtained and the grant is approved and otherwise secured from FEMA.
In the event that the subject FEMA Hazard Mitigation Grant is approved, then the County shall be bound to pay the 25% match.

Resolution 2025-10 Joint Pre-Disaster Mitigation Plan: Motion by Mike Kenzy, second by Sonny Harrowa, to approve Resolution 2025-10 Pre-Disaster Mitigation Plan. All voted Aye. Motion Carried.
RESOLUTION 2025-10
WHEREAS, Stanley County has identified the desire to update their Stanley County/Hughes County Joint Pre-Disaster Hazard Mitigation plan in order to improve the quality of life for all residents of the county; and
WHEREAS, Stanley County anticipates updating their Joint Pre-Disaster Hazard Mitigation plan. The county proposes to apply to the SD Office of Emergency Management for Hazard Mitigation Grant funding to assist with the costs of updating the plan; and
WHEREAS, the County will provide ½ ($3,250) of the required 25% local funding match for total project costs, and
NOW THEREFORE BE IT RESOLVED that the Stanley County Commission authorizes Allan Rounds to sign and submit this letter of intent and application to the SD Office of Emergency Management for Hazard Mitigation Grant funding for development of a Stanley County/Hughes County Joint Pre-Disaster Hazard Mitigation plan update requesting up to $26,000.00.
This resolution is effective immediately upon passage

Discussion: Public Utilities Commission approved the agreement to allow West Central Electric to power Post 20 Legion baseball field with a ten-year limit, to be revisited at that time.
