The special meeting of the Stanley County Commission was called to order at 5:10 P.M. (CST) by Vice Chairman Sonny Harrowa with Commissioners Dennis Booth, Mike Kenzy and Craig Heller. Commissioner Dana Iversen was absent. Also present was State’s Attorney Tom P. Maher, Treasurer Bill Konst, Director of Equalization Tracy Schmitt, Fort Pierre Chamber of Commerce/Expo Center Shane Kramme, Levi Tibbs, Gary Grittner, and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.
AGENDA:  Auditor Burtch requested to Amend the Agenda by adding Resolution 2022-28 Declaration of Disaster-Blizzard and Resolution 2022-29 Contingency Transfer-Court Appointed Attorney, Government Buildings and Fairgrounds.

Expo Center: Shane Kramme presented the Commission with a report of the activities and events that have taken place at the Expo Center in 2022. Shane stated that it was another year of successful operation for the community venue. The Expo Center hosted fourteen separate events over the summer schedule. These events utilized seventy days within the six-month time frame which translates in an event or activity occurring approximately every 2.5 days. The Oahe Hockey Association (OHA) leases the Expo Center from October 1 thru April 1 on an annual basis. The OHA facilitates an entire schedule of youth hockey through high school hockey, as well as conduct open skate on weekends. From April 1 thru October 1.
Shane Kramme stated that the Expo Center Board of Directors have been proactive in addressing issues that occur within and around the structure that is approaching its 23rd year of use. These issues include the replacement and repair of parking lot lights, locker room shower replacement and the replacement of the lower portion of the fire suppression system. While these are not small items, Shane would like to mention that the Expo Center has thus far achieved its goal of remaining self-sufficient since its construction with its stewardship overseen by the four entities providing a great model of efficiency and cooperative effort.
Shane has already been taking bookings for the 2023 season and is working with the Stanley County Fairgrounds Manager to ensure another successful year for all involved. Shane and the Fort Pierre Chamber of Commerce look forward to the upcoming year with great excitement and anticipation.
Discussion: Levi Tibbs’ family was informed by the County that they had paid property taxes on someone else’s property. The County refunded the Tibbs’ family the amount that was paid in error, however, Levi questioned whether the Tibbs’ family is due interest? State’s Attorney Maher informed Levi that if they feel interest is due, please submit the request in writing for the January, 2023, meeting.
Emergency Management Services Agreement: Motion by Dennis Booth, second by Craig Heller, to accept and approve Vice Chairman Harrowa to sign 2023 Emergency Management Services Agreement, in the amount of $6,975.00. All voted Aye. Motion Carried.
Brule County 2023 Jail Contract: Motion by Dennis Booth, second by Mike Kenzy, to approve Brule County 2023 Jail Contract, with a daily rate of $62.00 per day. All voted Aye. Motion Carried.
Resolution 2022-26 Formal Supplemental Budget – Rural Access Infrastructure Fund: Motion by Mike Kenzy, second by Craig Heller, to approve Resolution 2022-26 Formal Supplemental Budget, Rural Access Infrastructure Fund, (Small Structure Project), in the amount of $16,817.46. All voted Aye. Motion Carried.

WHEREAS it is necessary to supplement the 2022 Annual Budget in order to carry on the indispensable functions of Stanley County; and
WHEREAS, the adoption of the proposed Supplemental Budgets were duly considered by the Stanley County Commission on the 20th day of December, 2022, in the Commission Room, pursuant to due notice; therefore, be it

STANLEY COUNTY RESOLUTION NO. 2022-28
RESOLUTION DECLARING A DISASTER
December Blizzard, 2022
WHEREAS, Stanley County, South Dakota suffered a severe winter storm caused by ice, snow, high winds, and blizzard conditions December 12 through December 17, 2022; another severe winter storm with the potential of producing more snow, high winds, and blizzard conditions with dangerous windchill temperatures is predicted to affect Stanley County through the end of December, 2022.
WHEREAS, the December 12 through 17, 2022, storm brought freezing rain, more than a quarter inch of ice, more than 24 inches of snow, 50+ mph winds and zero visibility, heavy drifting throughout the county roads causing them to be impassable for several days while county crews plowed the roads open. Multiple stranded motorists required rescuing using county, state, and local agencies’ resources. Heavy, wet snow proved to be very difficult to move.
WHEREAS, the resulting damage and destruction endangered and threatened the health, safety, and welfare of the public and the financial stability of the local governing units and the utility companies and power cooperatives generally; now,
THEREFORE, BE IT RESOLVED that the Board of Stanley County Commissioners does hereby declare a blizzard disaster emergency for Stanley County.
BE IT FURTHER RESOLVED THAT the Stanley County Commissioners do hereby declare a disaster and respectfully requests the Governor of the State of South Dakota to declare Stanley County a Disaster area and to request a Presidential Declaration of Disaster in order that assistance from state and federal agencies may be made available to Stanley County residents, communities, local businesses, the general population, and utility companies of the area affected, as we work to overcome this disaster.

Resolution 2022-27 Formal Supplemental Budget – American Rescue Plan Act: Motion by Dennis Booth, second by Mike Kenzy, to approve Resolution 2022-27 Formal Supplemental Budget, American Rescue Plan Act, in the amount of $62,500.00. All voted Aye. Motion Carried.
Bonus’ for Full Time County Employees: Motion by Dennis Booth, second by Craig Heller, to approve Bonus’ to be paid to 27 Full Time County Employees, including Law Enforcement, using the proposed longevity chart, totaling $62,500.00. All voted Aye. Motion Carried.
Discussion: Snow removal at the courthouse and the log cabin are a lot of work for the equipment used at the two County buildings. It is much appreciated when the County Highway Department and the City Street Department bring the loader or motor grader to clean the parking lots.
Law Enforcement Body and Unit Camera System: Auditor Burtch informed the Commission that Law Enforcement needs new body and unit camera system. The County received federal funds, Local Assistance & Tribal Consistency Fund (LATCF). Public safety is one area these funds are to be used for.
Christmas and New Year Holiday Closing: Stanley County offices will be closed December 23, 2022, December 26, 2022, and January 2, 2023.
