December 19, 2024
The special meeting of the Stanley County Commission was called to order at 5:00 P.M. (CT) by Chairman Craig Heller with Commissioners Mike Kenzy, Dana Iversen, Sonny Harrowa and Gary Grittner. Also, present was State’s Attorney Tom P. Maher, Director of Equalization Matthew Riter, Highway Superintendent Lee Smith, Hughes County Manager Lori Jacobson, Emergency Manager AJ Rounds, Nick Dooley, Don Kirkpatrick, Lura Kirkpatrick, Darla Tibbs, Mindy Kirkpatrick, Kelly Tibbs and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Resolution 2024-16 Energy Alternative Moratorium: Motion by Sonny Harrowa, second by Dana Iversen, to approve Resolution 2024-16 Energy Facilities Moratorium. All voted Aye. Motion Carried.

RESOLUTION NO. 2024-16
Energy Facilities Moratorium
PURPOSE: The Stanley County Board of Commissioners has determined there is a present need to study the impact of energy facilities in all Stanley County Zoning Districts in order to evaluate whether current zoning regulations reasonably address concern for public health, safety, and welfare.
WHEREAS SDCL 11-2-10 authorizes the Board of County Commissioners, in the interest of public health, safety, and general welfare, to adopt temporary zoning controls for a reasonable period of time in order to study, identify, and consider necessary land use regulations; and
WHEREAS the Stanley County Board of Commissioners desires to impose a moratorium on all energy facilities to allow the County time to adopt appropriate Ordinances.
NOW, THEREFORE, BE IT RESOLVED that the Board of Stanley County Commissioners does hereby authorize a one (1) year moratorium on the issuance of any new permits and/or approval of land uses for proposed energy facilities, in all Stanley County Zoning Districts.

Emergency Manager – AJ Rounds and Nick Dooley: AJ Rounds introduced himself as the new Director Emergency Management, and Nick Dooley as Assistant Director Emergency Management.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of November, which consists of blading, hauling gravel, and service and maintain equipment. Lee informed the Commission that Morris Inc has crushed 62,000 ton of gravel to date.
911 Signs – Lee Smith informed the Commission the Highway Department will start replacing 911 signs throughout the County, the signs will be replaced in sections. They are fading or gone.
Part-Time Employees Wages: Motion by Dana Iversen, second by Gary Grittner, to approve Highway Department Part-Time employees’ wages to increase to $27.00 per hour, effective January 1, 2025. All voted Aye. Motion Carried.

Record #9172 – Motion by Sonny Harrowa, second by Mike Kenzy, to approve Abatement and Refund for Record #9172, 2022 Taxes Due and Payable 2023 and 2023 Taxes Due and Payable 2024, in the amount of $3,666.22, as this property is exempt from property taxes. All voted Aye. Motion Carried.
Record #10679 – Motion by Dana Iversen, second by Gary Grittner, to deny abatement for Record #10679, 2022 Taxes Due and Payable 2023 and 2023 Taxes Due and Payable 2024. All voted Aye. Motion Carried.
Resolution 2024-15 Formal Supplemental Budget – Judicial Systems, Court Appointed Attorney Services, Juvenile Detention, Emergency & Disaster Services: Motion by Mike Kenzy, second by Dana Iversen, to approve Resolution 2024-15 Formal Supplemental Budget: Judicial Systems, Court Appointed Attorney Services, Juvenile Detention, and Emergency & Disaster Services, in the amount of $168,800.00. All voted Aye. Motion Carried.

FORMAL SUPPLEMENTAL BUDGET
WHEREAS it is necessary to supplement the 2024 Annual Budget in order to carry on the indispensable functions of Stanley County; and
WHEREAS, the adoption of the proposed Supplemental Budget were duly considered by the Stanley County Commission on the 19th day of December, 2024, in the Commission Room, pursuant to due notice; therefore, be it
RESOLVED by the Stanley County Commission that the following Supplement Budget be, and the same is, hereby approved for the purpose of providing budget to conduct the indispensable functions of Government, to wit:
Judicial Systems (Fund 101-130-422.03) - $30,000.00
Court Appointed Attorney Services (Fund 101-153-422.00) - $95,000.00
Juvenile Detention (101-215-429.0) - $30,000.00

WHEREAS, insufficient appropriation was made in the 2024 adopted budget for the Commissioners, Elections, Government Buildings, Director of Equalization, Veterans Service Officer, and Jail departments to discharge just obligations of said appropriations: and
WHEREAS SDCL 7-21-32.2 provides that transfers be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;
