The regular meeting of the Stanley County Commission was called to order at 5:02 P.M.(CT) by Chairman Dana Iversen with Commissioners Dennis Booth, Mike Kenzy, Craig Heller and Sonny Harrowa present. Also present were State’s Attorney Tom P. Maher, Treasurer Peggy Dougherty, Deputy Treasurer Susan Freeman, Director of Equalization Roger Fuller, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, Teri Heninger and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Treasurer Peggy Dougherty presented the Commissioners with the Treasurer Report, October bank statement and daily cash, delinquent real estate and mobile home taxes, tax trust, miscellaneous receipts (Grants, Register of Deeds, Clerk of Courts, Equalization, Fairgrounds, Auditor, motor vehicle), investments and Money Market reports. Auditor Philena Burtch presented the Commissioners with the October Budget Expenditure Report showing each department’s expenses as of October 31, 2020, Fiscal Revenue Report as of October 31, 2020, and Outstanding Disbursements by Account as of December 1, 2020.

Abatement – Record #9909 and Record #8231:
Motion by Sonny Harrowa, second by Mike Kenzy, to approve Abatement for Record #9909, 2019 Taxes Due 2020, in the amount of $23.51, including interest and penalty, as mobile home has been removed from County. All voted Aye. Motion Carried.
Motion by Craig Heller, second by Sonny Harrowa, to approve Abatement and refund for Record #8231, 2019 Taxes Due 2020, in the amount of $212.76, including interest and penalty, as this was double taxed. All voted Aye. Motion Carried.
Fairgrounds: Scott Deal informed the Commission that the fairgrounds has been winterized and people are using the Schomer barn more. Scott stated that since the new signs are installed at the Grandstand, the County should invest in some bumper buffers for the parking spaces in front of the Grandstand.
Welder: Motion by Craig Heller, second by Sonny Harrowa, to approve the purchase of a Hobart Champion Elite 260 Welder, not to exceed $3,500.00. All voted Aye. Motion Carried.
Square Tubing: Motion by Dennis Booth, second by Craig Heller, to approve the purchase of 300 1” x 1” x .065” x 24’ square tubing, not to exceed $4,755.00. All voted Aye. Motion Carried.
Pipe: Motion by Mike Kenzy, second by Craig Heller, to approve the purchase of 50 2 7/8” x 30’ drill stem pipe, not to exceed $1,900.00. All voted Aye. Motion Carried.
Add Deputy Treasurer to Bank Accounts: Motion by Craig Heller, second by Dennis Booth, to approve to add Deputy Treasurer Susan Freeman to all Bank accounts, ACH and Execubank. All voted Aye. Motion Carried.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of November 2020, which consists of mowing, hauling gravel, blading, screen gravel and work on equipment.
Plow Truck: Lee Smith has been looking for a plow/sander truck. He did locate one at surplus that might work for what they need. He is waiting for more information.
Cattle Guards: As per SDCL 31-25-2, 31-25-3, A cattle way may be constructed across or under the jurisdiction of the county if application for it is approved by the county board. It must be constructed in a manner directed by the county and at the expense of the applicant.
If the person on whose land the cattle way is constructed fails to keep it in good repair, the county may make any needed repairs and charge the cost to the landowner.
Raise – State’s Attorney Legal Assistant: Motion by Craig Heller, second by Sonny Harrowa, to approve $1.00 per hour, 90 day raise for State’s Attorney Legal Assistant Lacey Boxley, effective December 14, 2020. All voted Aye. Motion Carried.
Central South Dakota Enhancement District Joint Cooperative Agreement and Financial Commitment: Motion by Dennis Booth, second by Craig Heller, to accept and approve Chairman Iversen to sign the Joint Cooperative Agreement and Financial Commitment for 2021, between Central South Dakota Enhancement District and Stanley County. All voted Aye. Motion Carried.
Resolution 2020-15 – Contingency Transfer: Motion by Mike Kenzy, second by Sonny Harrowa, to approve Contingency Transfer Resolution 2020-15. All voted Aye. Motion Carried.

CONTINGENCY TRANSFER
WHEREAS, insufficient appropriation was made in the 2020 adopted budget for the Court Appointed Attorney, Government Building, and Fairgrounds departments to discharge just obligations of said appropriations: and
WHEREAS SDCL 7-21-32.2 provides that transfers be made by resolution of the board from the contingency appropriation established pursuant to SDCL 7-21-6.1 to other appropriations;
THEREFORE BE IT RESOLVED that the appropriation be transferred from the contingency budget to the Court Appt Attorney department budget 101-112-429.00 (Commissioners) $5,000.00 – Expenditure: 101-153-422.00 (Crt Appt Attrny) in the sum of $5,000.00; Gov Buildings Supplies 101-112-429.00 (Commissioners) $10,000.00 – Expenditure budget 101-161-426 (Gov Bldg Supplies) in the sum of $10,000.00; Fairgrounds department budget 101-112-429.00 (Commissioners) $45,000.00 – Expenditure budget 101-524-425 (Fairgrounds Repairs & Maint) in the sum of $45,000.00.
Motion by Mike Kenzy, second by Sonny Harrowa, to approve Contingency Transfer in the amount of $5,000.00 to Crt Appt Attrny Department, $10,000.00 to Gov Bldg Suppl Department, $45,000.00 to Fairgrounds Repairs & Maint Department. All voted Aye. Motion Carried.

2020 Year End Meeting has been set for 5:00 P.M., December 22, 2020.
Holiday Closing: Stanley County offices will be closed Thursday and Friday, December 24 and 25, 2020, in observance of the Christmas Holiday and Friday January 1, 2020, in observance of the New Year Holiday.
Executive Session – Personnel – SDCL 1-25-2(1): Motion by Craig Heller, second by Sonny Harrowa, to go into Executive Session-Personnel-SDCL 1-25-2(1) at 6:15 P.M. All voted Aye. Motion Carried.
