STANLEY COUNTY COMMISSION MEETING
MINUTES
April 18, 2023
The special meeting of the Stanley County Board of Equalization was called to order at 5:00 P.M. (CT) by Chairman Dana Iversen, with Commissioners Mike Kenzy, Craig Heller, Sonny Harrowa and Gary Grittner present. Also present were State’s Attorney Tom P. Maher, Director of Equalization Tracy Schmitt, Director of Equalization Assistant Philip Torres, Treasurer Bill Konst, Rob Skjonsberg, Bill Leimbach, by phone Jessica Hegge and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.
AGENDA: Motion by Sonny Harrowa, second by Craig Heller, to approve the Agenda. All voted Aye. Motion Carried.
Elderly/Disabled Assessment Freeze: Motion by Mike Kenzy, second by Craig Heller, to approve the list of 16 residents, who qualify for the Elderly/Disabled Assessment Freeze. All voted Aye. Motion Carried.
Disabled Veterans Property Tax Exemption: Motion by Sonny Harrowa, second by Gary Grittner, to approve the list of 11 residents who qualify for the Disabled Veterans Property Tax Exemption. All voted Aye. Motion Carried.
Tax Exempt: Motion by Craig Heller, second by Gary Grittner, to approve the list of Tax Exempt properties: Casey Tibbs Foundation; The Chapter of Calvary Cathedral; St. John’s Catholic Church of Fort Pierre; Fort Pierre Congregational United Church of Christ; Fort Pierre Volunteer Firefighter’s Association, Inc.; Grace Lutheran Church of Hayes, SD; Hayes Community Hall; Hayes Four Corners Volunteer Fire Department; Kirley Hall, Inc.; Masonic Cemetery; Mission Ridge Cemetery Association; Moose Lodge #1813 of Stanley County; Little Brown Church on the Prairie; Wakpa Sica Historical Society; and West River/Lyman-Jones Rural Water Systems, Inc. All voted Aye. Motion Carried.
These assessments are for 2023 taxes payable in 2024.

Meeting of the Stanley County Commissioners was called to order by Chairman Iversen at 5:48 P.M.
Public Hearing – Resolution 2023-10 – West Central Cooperative Inc: Having no public comment or discussion, Motion by Sonny Harrowa, second by Mike Kenzy, to approve Resolution 2023-10 West Central Cooperative Inc. County-Wide Permission for Rural Electrification Lines, limited to a 20-year term. All voted Aye. Motion Carried.
RESOLUTION 2023-10
The Board having held a hearing on the application of West Central Electric Cooperative, Inc., for authority for county-wide permission to erect poles, wires, and lines in Stanley County for the purpose of providing rural electrification; and
WHEREAS, West Central Electric Cooperative, Inc., a corporation organized and existing under and by the laws of the State of South Dakota, qualified and authorized to operate and transact business in the State of South Dakota, has filed application in the form required by law with the Auditor of Stanley County, South Dakota, for a right-of-way permit to operate, maintain, and construct whenever necessary its electric transmission and/or distribution lines in Stanley County for the purpose of providing rural electric service, and
WHEREAS the Board of Commissioners of said Stanley County have examined said application and found:
1. That said application is in the form and contains the information required by law.
2. That said application was filed with the County Auditor of Stanley County, and all persons, firms, or corporation owning or operating transmission, telegraph and telephone lines, and pipeline, within Stanley County were notified by registered or certified mail at least (10) days prior to the Board's hearing on said application, and that said notice stated the time and place, when and where such application should be heard.
3. That the Board has considered the complaints of all parties appearing, and has adjusted all differences between applicant and the owner or owners of any transmission, telegraph or telephone lines affected by the Board's decision upon said application.
4. That the operation, maintenance and construction (if and when found necessary by the applicant) of said electric lines will be to the public interest, and that said permit should be granted, subject to the conditions hereinafter set forth:
THEREFORE, be it RESOLVED, by the Board of County Commissioners of Stanley County, South Dakota, that West Central Electric Cooperative, Inc., a corporation, organized and existing under and authorized to operate and transact business in the State of South Dakota, its successors and assigns, hereinafter called the grantee, by and hereby are authorized and granted a right-of-way permit to construct, operate, and maintain same as and whenever necessary, electric transmission and distribution lines on, along, and under public highways in Stanley County, South Dakota. That this permit is granted pursuant to SDCL 31-26-12, authorizing a general grant as to all public highways for rural electrification purposes and it is found and resolved hereby that the grantee, West Central Electric Cooperative, Inc., is operating its entire system primarily and principally for rural electrification purposes.
BE IT FURTHER RESOLVED, that this permit is subject to the following conditions, and such other reasonable regulations as the Legislature may hereinafter prescribe:
1. The grantee shall not in any way have the exclusive right to use such highway for the
constructing of electric poles, electric wires, and fixtures.
2. The electric poles, electric wires, and fixtures shall be so constructed as not to prevent the
public use of any road or the navigation of any stream.
3. When any highway along such line has been constructed shall be changed, grantee shall
upon ninety (90) days’ notice in writing remove such line to the highway as changed, unless an agreement shall be made to allow the same to remain pursuant to law.
4. The grantee shall construct and maintain said poles, wires, and line in accordance with
the national electrical safety code adopted by the Bureau or Standards of the United States Department of Commerce.
5. This right-of-way permit shall be effective and in full force for a period of twenty (20)
years from date hereof.
6. That the grantee shall notify the County in writing at least thirty (30) days prior to the
construction of any additional lines along and on all public highways in Stanley County.
