April 11, 2023
The regular meeting of the Stanley County Commission was called to order at 5:00 P.M.(CT) by Chairman Dana Iversen with Commissioners Mike Kenzy, Craig Heller, Sonny Harrowa and Gary Grittner. Also present was State’s Attorney Tom P. Maher, Treasurer Bill Konst, Fairgrounds Manager Scott Deal, Highway Superintendent Lee Smith, Deb Schiefelbein, Kelly Tibbs and Auditor Philena Burtch. The meeting commenced with the recitation of the Pledge of Allegiance.

Treasurer and Auditor Report: Treasurer Bill Konst presented the Commissioners with the Treasurer Motor Vehicle Report for March 2023. The Commissioners discussed CD’s with Bill Konst, Bill stated that he will check with other County Treasurers and the banks. Auditor Philena Burtch presented the Commissioners with the February 2023 Budget Expenditure Report showing each department’s expenses as of February 28, 2023, and Outstanding Disbursements as of April 6, 2023.
SALARIES BY OFFICE: Commissioners - $4,521.65; Auditor - $4,571.06; Treasurer - $6,629.14; States Attorney - $9,559.32; Custodial - $4,328.89; Director of Equalization - $4,135.68; Register of Deeds - $4,850.44; Road & Bridge - $33,650.89; Weed & Pest - $698.33; Fairgrounds - $10,550.88; Extension - $1,879.54; Employee Health Insurance - $14,635.21; SD Retirement System, withheld and match - $14,320.40; Electronic Transfer; FICA, Medicare and Withholding Tax - $26,127.90.

Fairgrounds: 4-H Shooters & Archery Storage Units: Scott Deal informed the Commission that he has been approached by 4-H Shooters & Archery regarding storage units’ availability at the fairgrounds. Scott is looking into storage containers.
Toolcat: Scott Deal informed the Commissioners that the Toolcat is broke down. While it was at the mechanics shop, it was discovered that the machine has more issues that will need to go out of town for repairs. Scott will need to rent a Toolcat until the fairgrounds Toolcat is fixed.
Backhoe: Scott Deal informed the Commissioners that the mechanic working on the backhoe is waiting for the parts to be shipped.
Building Updates: Scott Deal informed the Commissioners that the concrete has been poured at the fairgrounds shop. The small crows nest has been moved and the small concrete slab has been poured. And the 20’x12’ building is now set on a concrete slab. The concrete floor in the fairgrounds shop makes working on equipment and projects better. Scott also informed the Commissioners that the cat-walk is almost complete.
Highway Department: Lee Smith presented the Commission with a report of work performed by the Highway Department for the month of March, 2023, which consists of blading, snow removal, repair cattle guard on Mission Ridge Road, and service and maintenance of equipment.
Auto Gates: If the person on whose land the cattle way is constructed fails to keep it in good repair, the county may make any needed repairs and charge the cost to the landowner. (SDCL 31-25-2, 31-25-3)
The county board may authorize landowners to erect and maintain fences across such county highways.
Bridge Inspection: Motion by Gary Grittner, second by Mike Kenzy, to approve Bridge Reinspection Program Resolution For Use With SDDOT Retainer Contracts. All voted Aye. Motion Carried.
WHEREAS, 23 CFR 650 Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria. These culverts are reinspected at intervals not to exceed four years.
THEREFORE, Stanley County is desirous of participating in the Bridge Inspection Program.
The County requests SDDOT to hire Brosz Engineering, Inc. for the inspection work. SDDOT will secure federal approvals, make payments to the Consulting Engineering for inspection services rendered, and bill the County for 20% of the cost. The County will be responsible for the required 20% matching funds.

RESOLUTION DECLARING A DISASTER
April Winter Storm, 2023
WHEREAS, Stanley County, South Dakota suffered a severe winter storm caused by ice, snow, high winds, and blizzard conditions April 4, 2023, through April 6, 2023.
WHEREAS, the April 4 through April 6, 2023, storm brought more than 12 inches of snow, 30+ mph winds and zero visibility, heavy drifting throughout the county roads causing them to be impassable for several days while county crews plowed the roads open. Multiple stranded motorists required rescuing using county, state, and local agencies’ resources. Heavy, wet snow proved to be very difficult to move.
WHEREAS, the resulting damage and destruction endangered and threatened the health, safety, and welfare of the public and the financial stability of the local governing units and the utility companies and power cooperatives generally; now,
THEREFORE, BE IT RESOLVED that the Board of Stanley County Commissioners does hereby declare a blizzard disaster emergency for Stanley County.
BE IT FURTHER RESOLVED THAT the Stanley County Commissioners do hereby declare a disaster and respectfully requests the Governor of the State of South Dakota to declare Stanley County a Disaster area and to request a Presidential Declaration of Disaster in order that assistance from state and federal agencies may be made available to Stanley County residents, communities, local businesses, the general population, and utility companies of the area affected, as we work to overcome this disaster.

New Hire – Director of Equalization Assistant: Motion by Craig Heller, second by Sonny Harrowa, to approve new hire of Director of Equalization Assistant Philip Torres, at $18.00 per hour, any cost-of-living increase approve by Commission for all County employees, including benefits, start date of April 11, 2023. All voted Aye. Motion Carried.
Discussion: Deb Schiefelbein discussed with the Commissioners options to fix the drainage issue around the Sansarc School located behind the Log Cabin. The discussion is to lift the school, place fill-dirt and stabilizers to raise the building, sloping the landscape so the run off goes towards the water canals. Deb also asked if bollards could be placed between the Stanley County School parking lot and the Sansarc School to keep snow piles away from Sansarc School.
New National Opioids Settlements: Motion by Gary Grittner, second by Craig Heller, to accept and approve Auditor Burtch to sign New National Opioid Settlements Participation Forms for Stanley County to participate. All voted Aye. Motion Carried.
Annual Service Proposal & Contract for Frontline Warning Systems: Motion by Mike Kenzy, second by Craig Heller, to accept and approve Chairman Iversen to sign Annual Service Proposal & Contract for Frontline Warning Systems for outdoor warning siren. All voted Aye. Motion Carried.
Raise – Treasurer William Konst $2,500.00 6-month salary increase: Motion by Craig Heller, second by Sonny Harrowa, to approve 6-month salary increase for Treasurer William Konst, in the amount of $2,500.00, effective April 3, 2023. All voted Aye. Motion Carried.
Automatic Budget Supplement – County Veterans Service Officer: Motion by Gary Grittner, second by Craig Heller, to approve Automatic Budge Supplement for County Veterans Service Officer, in the amount of $1,875.00, to reflect State Funded County/Tribal Veterans Service Officer Salary Supplemental. All voted Aye. Motion Carried.
Catholic Community Foundation 2023 Raffle: Motion by Mike Kenzy, second by Craig Heller, to approve Catholic Community Foundation 2023 Annual Raffle. All voted Aye. Motion Carried.
Executive Session – Personnel – SDCL 1-25-2(1): Motion by Sonny Harrowa, second by Gary Grittner, to go into Executive Session-Personnel-SDCL 1-25-2(1) at 6:16 P.M. All voted Aye. Motion Carried.
Chairman Iversen declared to reconvene at 6:21 P.M.
Commissioner Discussion – Committees: The Commissioners agree that the Personnel Handbook needs to be reviewed and updated. Commissioner Grittner informed the Board that he attended a Fort Pierre Development meeting. The discussion was no one wants to work, no housing, no industry, and no transportation. Commissioner Grittner stated that River Cities Transit is planning to expand by add on to their existing building. Commissioner Grittner contacted SD DOT regarding the rough railroad crossing on US Highway 14/34. SD DOT explained that repairs to the railroad crossing will be complete after the construction of the new Missouri River Bridge is complete. Commissioner Grittner informed the Board of the different Grants available with the help Central South Dakota Enhancement District.
